AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA, CALIFORNIA, AMENDING SECTION
3 OF ORDINANCE NO. 1388, RELATING TO THE
CONSTRUCTION TAX INCREASE OR DECREASE AND
DECLARING THE URGENCY, THEREOF, AND PROVIDING
THAT THIS ORDINANCE SHALL TAKE EFFECT IMMEDEATELY.
The City Council of the City of West Covina does ordain as
follows:
SECTION 1. Section 3 of Ordinance No. 1388 is hereby amended
to read as follows:
''SECTION 3. That the tax imposed by this Ordinance shall be
increased or decreased annually as of July 1 of
each calendar year, commencing on July 1, 1979,
in an amount equal to the increase or decrease
from the Base Index in the then latest available
Consumer Price Index, as prepared and released by
the Federal Government or any other governmental
agency for the Los Angeles/Long Beach area. The
last index published for the month of June, 1978
.shall be deemed to be the base index for the pur-
pose of this Section. Notwithstanding the above,
the City Council may by Resolution suspend any
increase of the tax imposed.under this Section,
`for a period of one fiscal year, in the event the
' City Council determines said suspension to be
equitable in.order.to_adjust the impact of, said
tax at the end of said )period of suspension the
increase or 'decrease in said tax provided for in
the 'Section shall be automatically reinstated
unless otherwise suspended in accordance herewith
by the C i.ty Council.
SECTION 2. The facts given rise to the urgency thereof are as
follows:
Unless this Ordinance is passed immediately, the above mentioned
construction tax will be automatically increased pursuant to the existing pro-
visions of Section 3 of this Ordinance. It -,has been.determined by the City
Council that'any increase of such taxes would be inequitable and not necessary
for the current budgetary purposes. The City's budget was prepared and approved
on the basis of no increase in said construction tax and to prevent the auto-
matic increase in said tax on July 1, 1979 and to provide the City Council with
the implementing authority to suspend said yearly increase as is necessary this
Ordinance must become effective immediately upon its adoption. In addition,
this Ordinance shall take effect immediately upon its adoption pursuant to Section
36937 (d) of the Government Code, since the subject matter of this Ordinance
relates to taxes and.the usual and current expenses of the City. This Ordinance
is therefore, declared to be an urgency measure and shall take effect immediately
upon its adoption. A statement of facts constituting the basis of such urgency
• is as set forth herein.

SECTION 3. `The City Clerk shall certify to the adoption of
this Ordinance and cause the same to be published in the manner required by
law.
