Ordinance - 1431ORDINANCE NO. 1431 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING CERTAIN SECTIONS OR ARTICLES I, II, III, IV, AND VI OF THE WEST • COVINA MUNICIPAL CODE RELATING TO FUNCTIONS OF THE CITY CLERK p The City Council of the City of West Covina does hereby ordain as follows: "4. SECTION 1. Section 1104 of the West Covina Municipal Code relating to the distribution of said Code, is hereby amended to read as follows: 111104. DISTRIBUTION OF CODE Not less than three copies of this Code shall be filed for -use and examination by the public in the office of the City Clerk." SECTION 2. Section 1106 of the West Covina Municipal Code relating to amendments of said Code, is hereby amended to read as follows: "1106. AMENDMENTS The City Clerk shall prepare typewritten or printed copies of such changes in the Code for insertion in the loose- leaf copies thereof. Every section of the Code so changed shall have printed thereon a notation of the ordinance number pur- suant to which such change is adopted." SECTION 3. Section 2102 of the West Covina Municipal Code relating to amendments of said Code, is hereby amended to read as follows: "2102. MEETINGS OF COUNCIL All meetings ofothe City Council shall be conducted in an orderly manner designed to expedite the business of the City Council .as hereinafter set forth." SECTION 4. Section 2103 of the West Covina Municipal Code relating to the agenda, is hereby amended to read as follows: O 0 0 "2103. AGENDA 0 • All reports, communications, ordinances, resolutions, documents or other matters -shall be submitted to the Council, as far in advance of each Council meeting as time for preparation will permit.- The City Manager shall arrange a list of the mat- ters to be brought before the Council according to the order of business and furnish each member of the Council, the City Attorney and the City.?Clerk with a copy of the agenda on the afternoon of the Friday preceding the regular Council meeting. No matter may be considered by the City Coucil other than those matters on the agenda without the consent of a majority of the City Council present at the meeting. The City Manager shall be responsible for.furnishing to the Council a written report covering items of business to be considered by the Council." SECTION 5. Section 2105 of the West Covina Municipal Code relating to the procedure of meetings, is hereby amended to read as follows: "2105. PROCEDURE OF MEETINGS All meetings of the Council shall be open to the public in accordance with the applicable provisions of the Government • Code except executive sessions relating to personnel matters only. Promptly at the hour set by law on the day of each regular meeting, the members of the Council, the City Clerk, City Attorney and City Manager shall take their regular places in the Council Chambers, and the business of the Council shall be taken up for consideration and disposition in the order established by the Council." 64 U SECTION 6. Section 3186 of the West Covina Municipal Code relating to the loading or merchandise, is hereby amended to read as follows: "3186. SAME. LOADING OR UNLOADING MERCHANDISE No person shall place upon any public street of the City, except as hereinafter provided any automobiles, wagon or any other vehicle, boxes, goods, wares, merchandise, building material or other articles which will obstruct the free use of such public street, avenue, alley, or sidewalk without a special permit therefor first having been obtained from the City Treasurer provided that this Section shall not apply to such obstruction as is the result of loading or unloading merchandise in the usual or ordinary manner and course of business unless such obstruction is permitted to remain on such public street, avenue, alley or sidewalk for a period of two hours or more." SECTION 7. Section 4307.3 of the West Covina Municipal Code relating to licensing duties, is hereby amended to read as follows: "4307.3 SAME. PERFORMANCE OF LICENSING DUTIES The licensing functions and duties imposed by Section 4307 on the Chief of Police may be performed by the contract pound service." SECTION 8. Section 4321.2 (a) of the West Covina Municipal Code relating to dog licenses, is hereby amended to read as follows: "4321.2(a) SAME RELEASE REQUIREMENTS (a) PRESENTING A CURRENT LICENSE. There has been presented to the Pound Master a current license for such dog issued by the City or if the person keeping, harboring or having such dog is not a resident of the City, such non-resident per- son has presented to the Pound Master a current license con- forming to this Chapter for such dog issued by any other muni- cipality in the County or by the County;" SECTION 9. Section 4319 of the West Covina Municipal Code relating to dog license certificates, is hereby amended to read as follows: 114319. CERTIFICATES REQUIRED FOR DOG LICENSING Every person applying for dog license whether to the Contracting Pound Service of the City, or the City must exhibit a certificate issued by a person licensed by the State, or any -2- other state or nation, to practice veterinary medicine which certificate shall show that the dog for which the license shall be issued has been vaccinated in accordance with the provisions of Sections 4318 and 4318.2. A license for such dog shall not be issued unless and until such a certificate is so exhibited." SECTION 10. Section 6239 of the West Covina Municipal Code relating to revocation of license, is hereby amended to read as follows: "6239.. REVOCATION AND SUSPENSION Every license heretofore or hereafter granted under the provisions of this Chapter or any preceding ordinance is granted and used by all parties receiving or using the same subject to the express condition that the City Council may revoke the same at any time when it is determined by the City Council that any state of facts exists upon which it would be authorized to deny an application for such license, or permit, if requested, or that the premises where the business is conducted are not in good and sanitary condition, are not properly drained or are in a dangerous condition, or that the person to whom such license was issued or any of his agents, servants or employees, or any other person in charge of or employed about the business for which the same was issued, has violated any of the conditions of the license, or permit, if any, or terms of this Code or of any law of the State, now or hereinafter in force, regulating the occupation or business for which such license is issued, or that the license or permit was obtained by fraudulent repre- sentations, or that the holder is an unfit person to be trusted with the privileges granted by said license, or has conducted his business in an immoral or disorderly manner, or has failed to make every reasonable effort to maintain order among his customers and patrons and to prevent violations of law or ordi- nance by them, or that the business has been so conducted as to be a public nuisance; provided, however, that no license shall be revoked without giving the holder thereof an opportunity to appear before the City Council and be heard in his own behalf. The City Council shall cause a notice of such hearing to be given:.to the holder of such license at a time not less than five days before the hearing. At the time set for the hearing or at the date to which said hearing may be heard and may present any facts to show why such license should other persons who may attend the hearing and present reasons why the license should or should not be revoked, and may, if it so desires, place under oath and question any person before it; provided, that the City Council may close the hearing when it is convinced that no public good will result from its continuance. At the close of the hearing, or at any time within thirty days thereafter, the City Council shall determine from the facts produced at the hearing, and from any other facts in its possession, whether or not the license should be revoked, and shall make its order accordingly and may make such order conditional upon the doing or not doing of any act by the holder of the license or his agents or servants, which the City Council deems for the public good. On the revocation of the license no part of the money in the hands of the City shall be returned, but such license fee shall be forfeited to the City. Notice of such revocation shall be given to the license holder by the license collector. A license may be suspended for such time and subject to such con- ditions as the City Council may impose in the same manner and for the same reasons that a license may be revoked. (Ordinance 970 - 6/13/66) -3- SECTION 11. Section 6322 of the West Covina Municipal Code relating to taxicab.. applications, is hereby amended to read as follows: 11632.2 APPLICATIONS. FORMS AND INFORMATION • Any person may apply to the City for a permit to operate an automobile or automobiles for hire, upon the streets of the City, by filing with the City Treasurer of the City, upon forms to be supplied by the City, an application setting forth the following information, viz: (a) The name, age, address and length of residence in the City of said applicant. (b) Whether applicant was previously engaged in the business for which a permit is requested, and if so, the location and length of time thereof. (c) The name and address of five or more local references. (d) If applicant is a corporation, a copy of the articles of incorporation shall be attached to the application; if a part- nership, a copy of the partnership agreement. (e) The number of automobiles for hire to be used in the business of the applicant, and the following information concern- ing each automobile: trade name, year model, motor number, type, state license number, mileage and detailed statement of condition of tires,.brakes, body, upholstery and motor. (f) Such other and further information as may be required by the City Council." SECTION 12. Section 6324 of the West Covina Municipal Code relating to the issuance of a taxicab permit, is hereby amended to read as follows: "6324. ISSUANCE OF PERMIT. At the time set for the hearing of such application, the City Council may examine the applicant and all persons interested in the matter set forth in said application, and shall determine whether or not the public interest, convenience and necessity, require the issuance of the permit applied for, and if it be found by the Council that the public interest, convenience and necessity, require the issuance of the permit applied for, it shall by resolution order the City Treasurer to issue an owner's permit in accordance with said.application, subject to the filing and approval of a policy or certificate of insurance as herein- after provided, and subject to such conditions as may be imposed by said resolution including the minimum and maximum number of vehicles that may be used." SECTION 13. Section 6326 of the West Covina Municipal Code relating to the. certificate of insurance, is hereby amended to read as follows: "6326. CERTIFICATE OF INSURANCE REQUIRED. Before an owner's permit shall be issued by the City Treasurer, the applicant to whom such permit shall have been awarded by the City Council as aforesaid, shall deliver to the City Treasurer a policy or certificate of insurance, executed by a company duly authorized under the laws of the State to do an insurance business by the provisions of which policy the said company promises and undertakes to pay:.in full all claims for damages to persons or property resulting from the operation of the automobiles referred to in said application, provided, that -4- the maximum amount for which liability shall be assumed for injury to or death of one person in any one accident shall be not less than $50,000.00, and for injury to or death of more • than one person in any one accident shall be not less than $100,000.00, and the maximum amount for which liability shall be assumed for injury to or destruction of property if any such insurance has been canceled or has expired, and has not been reinstated nor replaced with other insurance within ten-.. days after the expiration or cancellation thereof, then the permit which has been issued for the operation of such auto- mobile or automobiles for hire covered by such insurance shall be automatically canceled, annulled and set aside. SECTION 14. Section 6332 of the West Covina Municipal Code relating'to driver's permits, is hereby amended to read as follows: "6332. DRIVER'S PERMIT. TAXICABS. Any person may apply to the City for a driver's permit to drive an automobile for hire, upon the streets of the City, by filing with the City Treasurer of the City, upon forms to be supplied by the City, an application for a driver's permit setting forth the name and address of the applicant, and such other information as may be required or deemed necessary or desirable by the City Council to enable the Council to ascertain whether the applicant fulfills the requirements herein set forth." SECTION 15. Section 6312 of the West Covina Municipal Code relating to fireworks stands, is hereby amended to read as follows: "6312. FIREWORKS STANDS. Stands may be erected ten days prior to the start of sale and must be removed, and the debris removed, no later than ten days after the last day of sale. A fee of $25.00 shall be posted for each stand with. the City Treasurer at the time of issuance of the permit. This -fee will be returned if the debris and stand described above are removed within the stated time, otherwise the fee will be used to defray the cost of cleaning up the area and will not be,returned. 'Violation of the dates of sale will mean immediate cancellation of the permit and for- feiture of the bond. (Ordinance No. 699 - 4/24/61) SECTION 16. Section 4318.3 relating to rabies vaccination certificates, is hereby amended -to read., as follows: "4318.3. SAME. CERTIFICATE. - Every person practicing veterinary medicine in the City who vaccinates a dog with rabies vaccine. shall issue to the person keeping, harboring or having such dog a. certificate which is signed by said veterinarian and which states thereon the name and description of said dog, the date of such vaccination and the type of vaccine used.." , - 5 - n is 0 SECTION 17.
