AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA, CALIFORNIA, AMENDING SECTION
7502 OF THE WEST COVINA MUNICIPAL CODE RELAT-
ING TO UNDERGROUND UTILITY LINES.
•
The City Council of the City of West Covina. does ordain
as follows:
SECTION 1. Section 7502 of the West Covina Municipal
Code relating to the undergrounding of Utility Lines, is hereby
amended to read as follows:
"7502. UTILITY LINES REQUIRED UNDERGROUND.
(a) Utility lines including but not limited to, electric
communications, street lighting and cable television, shall be
placed underground unless special permission to construct said
lines above the ground is granted as provided in Subsection
(b) below or as provided in Section 7503. For the purposes
of this section, appurtenances and associated equipment such
as, but not limited to, surface mounted transformers, pedestal
mounted terminal boxes and meter cabinets, and concealed ducts
in an underground system may be placed aboveground. Any person
subdividing or developing land shall make the necessary arrange-
ments with the utility companies involved to provide for the
underground installation of utility lines.
(b) The expansion of existing overhead facilities may
be approved by resolution of the City Council in the event
that the Council finds that each of the following conditions
• and requirements are complied with:
1. That the expansion is limited to the placement
of additional electric, communications, street
lighting or cable television lines on existing
utility poles. The replacement of existing
utility poles for the purposes of expansion
shall not be permitted.
2. That the City Council shall make a. finding that
the proposed expansion will not endanger the
public health, safety and welfare.
3. That the person or party requesting the expan-
sion of existing overhead facilities shall enter
into an,agreement with the City which shall pro-
vide that at the time the existing overhead
facilities are undergrounded, any and all ad-
ditional lines which constitute the expansion
application, shall also be undergrounded at the
Applicant's expense. A bond or other security
subject to the approval of the City Attorney
shall be posted guaranteeing execution of such
an agreement.
• 4. The proposed expansion shall not substantially
alter the appearance of the existing overhead
facilities.
SECTION 2. The City Clerk shall certify to the adoption
of this ordinance and cause the same to be published in the manner
prescribed by law.
