AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA AMENDING ORDINANCE NO. 1388 TO PROVIDE
ADDITIONAL EXCEPTIONS TO CONSTRUCTION TAX
• The City Council of the City of West Covina does ordain as
follows:
SECTION 1. Article VIII of the West Covina Municipal Code is
hereby amended to read as follows:
CHAPTER 7 - PUBLIC WORKS CONSTRUCTION TAXES
8700. TAX REQUIRED
No building or structure shall hereafter be erected, constructed,
enlarged or relocated onto any property within the City until a tax, as set
forth in this Chapter, has.been paid to the Building and Safety Director.
No building permit shall be issued for erection, construction, enlargement
or relocation of a building or structure until such tax has been paid. Any
permit issued without receipt of the required tax is hereby declared invalid
and shall be cancelled by the Building and Safety Director. The above speci-
fied fee shall be in addition to any other fees or taxes specified in this
Code.
8701. Taxes to offset the cost of public works improvements
made necessary by development of property shall be assessed as follows:
A tax of $300 shall be paid to the Building and Safety Director
for each 1000 square feet of building gross floor area or fraction thereof
• proposed for construction, erection, enlargement or relocation.
Exception:
1. Carports, garages, workshops, patio structures and similar
buildings that are accessory to single family dwelling
uses.
2. Additions/enlargements of less than 400 sq.ft. for
existing single family homes.
SECTION 2. This Ordinance shall take effect immediately upon
its adoption pursuant to Section 36937(d) of the Government Code, since the
taxes levied hereby are for the usual and current expenses of the City.
SECTION 3. The tax imposed by this Ordinance shall be increased
or decreased annually as of July 1 of each calendar year, commencing on
July 1, 1979, in an amount equal to the increase or decrease from the Base
Index in the then latest available Consumer Price Index, as prepared and
released by the Federal Government or any other governmental agency for the
Los Angeles/Long Beach area. The last index published for the month of June
1978 shall be deemed to be the base index for the purpose of this Section.
SECTION 4. Validity of Ordinance. If any section, subsection,
sentence, clause, phrase or portion of this Ordinance is for any reason
held to be invalid or unconstitutional by the decision of any court of com-
petent jurisdiction, such decision shall not affect the validity of the
remaining portions of this Ordinance. The City Council hereby declares that
it would have adopted this Ordinance and each section, subsection, sentence,
clause, phrase, or portion thereof, irrespective of the fact that any one
or more sections, subsections, phrases or portions be declared invalid or
unconstitutional.
SECTION 5. The City Clerk shall certify to the adoption of
this Ordinance and shall cause the same to be published in the manner prescribed
by law.
