ORDINANCE NO. 1386
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA, CALIFORNIA, AMENDING SECTIONS
2622 AND 6235.8 OF THE WEST COVINA MUNICIPAL
COPE, RELATING TO BUSINESS LICENSE TAXES FOR
SANITARY LANDFILL DISPOSAL FACILITIES AND THE
USES THEREOF.
The City Council of the City of West Covina does ordain as
SECTION 1. Section 2622 is amended in the West Covina Municipal
"2622. PARK AND RECREATION PROJECTS
There is hereby appropriated and shall be paid into said Capital
Outlay Fund the proceeds of the business license tax levied on sanitary landfill
disposal facilities pursuant to Section 6235.8 of this Code. The funds so paid
into the Capital Outlay Fund shall be expended for park and recreational capital
outlay projects or otherwise directed by the City Council of the City of West
Covina."

SECTION 2. Section 6235.8 is amended in the West Covina Municipal
"6235.8. CATEGORY CODE V. SANITARY LANDFILLS AND DISPOSAL FACILITIES.
All sanitary landfill and disposal facilities and sites shall pay,
• commencing on June 30, 1978, a monthly business license tax in an amount equal to
6% of gross receipts received from disposal of waste matter on the site, and
commencing on June 30, 1979 a monthly business license tax in an amount equal to
8% of gross receipts, and commencing on June 30, 1980 a monthly business license
tax in an amount equal to 10% of gross receipts, provided that the total amount
of the tax shall not be less than $100,000 per calendar year. The first such
payment filed with a Statement of Gross Receipts from the operation of any sani-
tary landfill and disposal site which is subject to taxation pursuant to this
section shall be due and payable by the last day of the following month in which
the Statement of Gross Receipts applies, and monthly thereafter. Said Statement
of Gross Receipts shall not be -.conclusive as to the matter set forth therein,
nor shall the filing of the same preclude the City from collecting, by appropriate
action, such sums as are actually due and payable. Such Statement and each of the
several items therein contained shall be subject to audit and verification by the
City tax collector to inspect the books and records of the licensee as may be
necessary to verify or ascertain the amount of the license fee due."
SECTION 3. That this Ordinance shall take effect immediately upon
its adoption pursuant to Section 36937 (d) of the Government Code, since the taxes
levied hereby are for the usual and current expenses of the City.
SECTION 4. Validity of Ordinance. If any section, sub -section,
sentence, clause, phrase or portion of this Ordinance is for any reason held to
be invalid or unconstitutional by the decision of any court of competent juris-
diction, such decision shall not affect the validity of the remaining portions
of this Ordinance. The City Council hereby declares that it would have adopted
this Ordinance and each section, sub -section, sentence, clause, phrase, or portion
thereof, irrespective of the fact that any one or more sections, sub -sections,
phrases or portions be declared invalid or unconstitutional.

SECTION 5. That the City Clerk shall certify to the adoption
• of this.Ordinance and shall cause the same to be published in the manner pre-
scribed by law.
