AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA, CALIFORNIA, AMENDING THE WEST COVINA
MUNICIPAL CODE BY AMENDING SECTIONS 10501.03 AND
10501.04 OF ARTICLE X, CHAPTER 1, PART V, RELATING
TO FILING FEES AND ENVIRONMENTAL IMPACT REPORT

The City Council of the City of West Covina does ordain
as follows:
SECTION 1. Section 10501.03 of the West Covina Municipal
Code is hereby amended to read as follows:
10501.03 FILING FEES.
a) The following filing fee shall be paid upon the
filing of an application:
$50.00 for printing, postage and miscellaneous
processing cost, plus $20.00 per hour for each
hour of staff time actually spent in the prep-
aration or processing of applications for an:
i. Unclassified Use Permit
ii. Approval of Precise Plan of Design
iii. Reclassification or Zone Change
iv. Planned Community Development Overlay Zone
V. Planned Residential Development Overlay Zone
vi. Development Plan for Planned Residential
or Community Development
vii. Variance (except those involving one single
family lot)
viii. Slight Modification (except those involving
one single family lot)
ix. Sign Adjustment
X. Model Home Marketing Complexes
xi. Appeal to the City Council from a decision
of the Planning Commission
xii. Appeal to the Planning Commission from a
decision of the Sign Review Board
An initial deposit of $550 shall be required
at the time of submittal of the environmental
information portion of the application, from
which the time charged will be funded. When
the deposit is exhausted, additional deposits
shall be required by the Planning Director.
b) A $200.00 filing fee shall be paid upon the filing
of an application for a variance involving one
single family lot.
c) A $50.00 filing fee shall be paid upon the filing
of an application for a slight modification in-
volving one single family lot.
d) The following filing fee shall be paid upon the
filing of an application for sign review and
Planning Department clearance for a sign permit:
i. Signs totaling less than 100 sq. ft.: $15.00
ii. Signs totaling 100 sq. ft. or more: $20.00 per
each hour of staff time spent in review and field
checking, with a minimum fee of $20.00.
SECTION 2. Section 10501.04 of the West Covina Muni-
cipal Code is hereby amended to read as follows:
10501.04 ENVIRONMENTAL IMPACT.REPORT FEES.
• If, pursuant to Section 10505 and the Guidelines
and Procedures for the evaluation of environmental impact of pro-
posed projects, the Planning Director declares that a proposed
action is not categorically exempt from the provisions of the
California Environmental Quality Act of 1970, he shall require
that the following fee be paid at the time he accepts the applica-
tion to prepare or process required environmental.impact documents:
$40.00 per -hour for each hour of staff
time actually spent in the preparation
or processing of initial studies and
Environmental Impact Reports, to be
funded from the initial deposit required
in Section 10501.03(a).
The fee for environmental impact documents
required in connection with variances or
slight modifications involving one single
family lot shall not exceed $50.00.
SECTION 3. That this Ordinance shall take effect
immediately upon its adoption pursuant to Section 36937(d) of the
Government Code, since the fees levied hereby are for the usual
and current expenses of the City.
SECTION 4. That the fee imposed by this Ordinance
• shall be increased or decreased annually as of July 1 of each calen-
dar year, commencing on July 1, 1979, in an amount equal to the
increase or decrease from the.Base Index in the then latest avail-
able Consumer Price Index, as prepared and released by the Federal
Government or any other governmental agency for the Los Angeles/
Long Beach area. The last index published for the month of June,
1978 shall be deemed to be the Base Index for the purpose of this
Section.
SECTION 5. Validity of Ordinance. If any section,
subsection, sentence, clause, phrase or portion of this Ordinance
is for any reason held to be invalid or unconstitutional by the
decision of.any court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions of this
Ordinance. The City Council hereby declares that it would have
adopted this Ordinance and each section, subsection, sentence,
clause, phrase, or portion thereof, irrespective of the fact that
any one or more sections, subsections, phrases, or portions be
declared invalid or unconstitutional.
SECTION 6. The City Council finds and determines that
the revisions of the zoning provisions of the West Covina Munici-
pal Code as contained in this Ordinance is a minor alteration in
the land use regulations and as such is categorically exempt under
® the California Environmental Quality Act of 1970 and the State
Guidelines.
SECTION 7. The City Clerk shall certify to the passage
of this Ordinance and shall cause the same to be published as
required by law.
