ORDINANCE NO. 1376
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF WEST COVINA ADDING SECTION 7320
TO THE WEST COVINA MUNICIPAL CODE CON-
CERNING CONTROL OF GRADING METHODS, DE-
CLARING THE URGENCY-.T.HEREFORE.-'AND-' PROVI:D.ING
• THAT THIS ORDINANCE SHALL; TAKE EFFECT
IMMEDIATELY.
The City Council of the City of West Covina does
ordain as follows:
SECTION 1. Section 73.20 is added.to the --'.West Covina_
Municipal,,Code to -read:;.;
"SECTION 7320 , CON,T.ROL„ !OF`GRA.D2NG-
Notwithstanding other sections in the Municipal
Code and the provisions .of the Uniform Building
Code, where grading is required adjacent to im-
proved residential lot(s) and where providing
for drainage primarily by grading will adversely
affect the aesthetics, privacy, security, and or
views of the adjacent lot(s) with fills exceeding
three feet in height, the City Engineer may require
the use of alternate drainage devices including,
but not limited to concrete swales, yard drains,
storm drains, sump pumps and raised floors. If
the use of alternate drainage devices is not suf-
ficient to mitigate any adverse impacts, the City
Engineer may require and/or permit the drainage of
• one lot across another lot provided that satisfactory
easements are provided.
Appeals of requirements of this section shall be
made to the Planning Commission and the decision
shall be final unless appealed to or called up by
the City Council. The fee for filing an appeal shall
be as shown in the Schedule of Fees as set from time
to time by resolution of the City Council, but in no
event shall be less than $65.00."
SECTION 2. The enactment of this ordinance is
necessary for the protection of the public peace, health and
safety and it shall be effective immediately upon its adoption.
The facts giving rise to the urgency hereof are as follows:
The existing ordinances of the City of West Covina
require that grading be done to meet certain minimum
drainage requirements. The methods of providing
minimum drainage are at the option of the person do-
ing the grading and have resulted in extensive changes
in the elevations of lots being graded to the detriment
of adjoining lots. In order to reduce or eliminate
future adverse impacts and yet preserve the minimum
drainage requirements, it is necessary to control the
• method of providing drainage. Since there are now
pending grading submittals which would cause adverse
impacts, it is necessary that this ordinance become
effective immediately.
SECTION 3. This ordinance shall become effective
immediately upon its passage, and the City Clerk shall certify

be published as required by law.
