AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF WEST COVINA AMENDING SECTION 7249
OF THE WEST COVINA MUNICIPAL CODE;,RELATING
TO INSURANCE REQUIREMENTS, DECLARING:.THE
URGENCY HEREOF AND PROVIDING THAT THIS
ORDINANCE SHALL TAKE EFFECT IMMEDIATELY.
The City Council of the City of West Covina does
ordain as follows:
SECTION 1. Section 7249 of the West Covina Municipal
Code is hereby amended to read as follows:
"7249. Insurance Required.
Prior to the issuance of any permit which
involves work in a public area, the permittee
shall supply a Certificate of Insurance naming
the City as an 'additional insured' and having
a 30-day written notice cancellation clause,
in such minimum amounts as may be established
from time to time by the City Council by
resolution."
SECTION 2. The enactment of this ordinance is necessary
for the protection of the public peace, health and safety and it shall
be effective immediately upon its adoption.
. The facts giving rise to the urgency hereof are as
follows:
The existing ordinances of the City of West Covina .
require that a contractor proposing to perform work in any public
right of way or other public area furnish the City with a Certificate
of Insurance naming the City as an additional insured under a policy
of liability insurance having a combined single limit liability of
$1,000,000. The cost of obtaining the Certificate of Insurance
required has made it impossible for many smaller contractors to perform
work within the City of West Covina. In order to remove this inequity
and yet preserve certain minimum insurance requirements for the pro-
tection of the public, it is necessary that this ordinance become
effective immediately.
SECTION 3. This ordinance shall become effective
immediately upon its passage and the City Clerk shall certify to the
passage of this ordinance and shall cause the same to be published
as required by law.
