ORDINANCE NO. 1324
A.N ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA, ADDING SECTIONS 2401.5 AND 6218.5
TO THE WEST COVINA. MUNICIPAL CODE, RELATING
TO ACCESS TO SUMMARY CRIMINAL HISTORY INFORMATION.
The City Council of the City of West Covina does ordain as follows:
SECTION 1. Effective January 1, 1976, State law requires that
Access to State and local summary_ criminal history information is limited to
those City officers who are specifically authorized by the 'City Council to
receive the. same. The City Council hereby finds and declares that in order
for the Personnel Officer and the License Collector to fulfill their obligations
under City ordinances, it is essential that they have access to such informa-
tion.
SECTION 2. Section 2401. 5 is hereby added to the West Covina
Municipal Code to read:
" 2401. 5. Personnel Officer - Acc-ess to Summary Criminal
History Information.
The Personnel Officer is authorized to have access
to State and Local summary criminal history information in
order to enable him to fulfill his employment and certification
duties and the implementation of the Personnel Rules and Regula-
tions governing the terms and conditions of City employment.
The provisions of Chapter 1321 of the Statutes of 1974 and of Section
432. 7 of the Labor Code shall apply to the use of such information. "
SECTION 3. Section 6218. 5 is hereby added to the West Covina
Municipal Code to read:
'6218. 5. License Collector - Access to Summary Criminal
History Information.
The License Collector is authorized to have access
to State and Local summary criminal history information in
order to enable him to fulfill his license issuance', collection
and enforcement duties pursuant to the provisions of this chapter.
The provisions of Chapter 1321 of the Statutes of 1974 and of Section
432. 7 of the Labor Code shall apply to the use of such information. "
SECTION 4. _ The City Clerk shall certify to the passage of this
ordinance and shall cause the same to be published as required by law.
