AN ORDINANCE OF THE CITY COUNCIL:..`OF THE CITY OF
WEST COVINA PROHIBITING THE SALE OF ALCOHOLIC
BEVERAGES IN SERVICE STATIONS DURING A PERIOD
OF STUDY NOT TO EXCEED ONE HUNDRED TWENTY DAYS
AND DECLARING THE URGENCY THEREOF, TO TAKE EFFECT
• IMMEDIATELY.
WHEREAS, Section 65858 of the Government Code of the
State of California authorizes the adoption of an interim ordinance
as an emergency measure prohibiting anyusage of land which may
be in conflict with a contemplated zoning proposal which the
legislative body, or Planning Commission, or the Planning Department
is considering, or studying, or intends to study within a reasonable
period of time; and
WHEREAS, the City Council has requested that the
Planning Commission study the existing zoning ordinance regulating
accessory sales in service stations and recommend any changes that
are necessary or desirable to protect the public health, safety
and general welfare.
NOW, THEREFORE, the City Council of the City of West
Covina does ordain as follows:
SECTION 1. Notwithstanding any other provisions of the
West Covina Municipal Code, no service station shall sell alcoholic
beverages to be consumed on or off the premises of the service
station.
• SECTION 2. This ordinance is declared to be an ordinance
for the immediate protection of the public health, safety and
general welfare.
'SECTION 3. This ordinance shall take effect upon its
adoption and shall continue in effect for a period of no longer
than four (4) months, provided, however, that after notice pursuant
to Section 65856 of the Government Code and a public hearing, the
City Council may extend the effectiveness of this ordinance for
eight months.
SECTION 4. The City Clerk shall certify to the passage
of this ordinance and cause the same to be published in the manner
required by law.
