Ordinance - 1318ORDINANCE NO. 1318 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA AMENDING SECTIONS 3117 AND 3156 OF THE WEST rCOVINA MUNICIPAL CODE AND ADDING PART 8 - �- BICYCLE REGULATIONS TO CHAPTER 1, ARTICLE III TO THE WEST COVINA MUNICIPAL CODE. The City Council of the City of West Covina does ordain as follows: SECTION 1. Section 3117 of the West Covina Municipal Code is amended to read: "3117. RIDING OR DRIVING OF ANIMALS Any person riding or driving an animal upon a highway is subject to the provisions of this Chapter which are applicable to the driver of a vehicle except those provisions which by their very nature, can have no application." SECTION 2. Section 3156 of the West Covina Municipal Code is amended to read: "3156. SIDEWALK TRAFFIC REGULATIONS The driver or operator of a vehicle shall not drive or operate the same nor shall the rider or driver of any animal ride or drive such animal within any sidewalk area of any parkway except at a permanent • or temporary driveway. For the purpose of this section a temporary driveway is a crossing or driveway suitably planked or otherwise protected to prevent damage to the curb or sidewalk." SECTION 3. The West Covina Municipal Code is hereby amended by the addition of Part 8 - BICYCLE REGULATIONS to Article 3, Chapter 1 reading as follows: Section 3 Part 8 is hereby added to Chapter 1, Article III of the West Covina Municipal Code to read: "PART 8 - BICYCLE REGULATIONS 3196.1. DEFINITIONS (a) SHARED ROUTE - Class III. A shared route is a street identified as a bicycle facility by "Bike Route" guide signing only. There are no special lane markings, and bicycle traffic shares the roadway with motor vehicles. (b) BIKE LANE - Class II. A bike lane is • a lane on the paved area of a road for preferential use by bicycles. It is usually located along the edge of the paved area or between the parking lane and the first motor vehicle lane. It is identified by "Bike Lane" or "Bike Route" guide signing, special lane lines and other pavement markings. Bicycles have exclusive use of a bike lane for longitudinal travel, but must share the facility with motor vehicles and pedestrians crossing it. A Class IIa bike lane is a minimum of five feet in width • and requires the prohibition of parking. A Class IIb bike lane is a minimum of 13 feet in width and permits parking within the bike lane. (c) BIKE PATH - Class I. A bike path is a special pathway facility for the exclusive use of bicycles, which is separated from motor vehicle facilities by space or a physical barrier. A bike path may be on a portion of a street or highway right of way or on a special right of way not related to a motor vehicle facility; it may be grade separated or have street crossings at desig- nated locations. It is identified with guide signing and also may have pavement markings. "3196.2. DUTY OF BICYCLE OPERATOR: OPERATION ON ROADWAY Any person riding a bicycle upon a highway is subject to the provisions of this Chapter applic- able to the driver of a vehicle except those provisions which by their very nature can have no • application." 113196.3. BIKE LANES: MOTOR VEHICLES PROHIBITED Motor vehicles, pedestrians, and animals are prohibited from using Class I or Class II bike lanes where such bike lanes have been duly established by the traffic authority and the proper signs and pavement markings have been installed. Pedestrians may use Class II bike lanes on highways where there is no sidewalk within the right of way." SECTION 4. City Clerk shall certify to the passage of this ordinance and shall cause the same to be published as required by law. PASSED AND APPROVED this 25th day of October , 1976.
