Ordinance - 1314ORDINANCE NO. 1314 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA AMENDING THE WEST COVINA MUNICIPAL CODE SO AS TO REZONE • CERTAIN PREMISES (Zone Change Application No. 504 Belcher-Kiely Associates)'; The City Council of the City of West Covina does ordain as follows: SECTION 1. The City Council does hereby find, determine and declare that the following zone change and amendment was duly initiated, that notice of hearing thereon was duly given and published, that public hearing thereon duly held by the Planning Commission and the Planning Commission denied the requested zone change and the applicant appealed the denial to the City Council, that public hearings thereon were duly held by the City Council and that the public conven- ience, necessity and general welfare and good zoning practice require that the following zone change and amendment be made. SECTION Z. The West Covina Municipal Code is hereby amended by the addition thereto of a new Section 9202. 2co reading as follows: 119202. 2co. Zone Changes. Notwithstanding the provisions • of Section 9202. 2h.-and the zoning map referred to therein, the following premises are hereby placed and included in the Medium Density Multiple Family (MF-20) Zone, to wit: An 8 acre portion of Lots 127 and 128 of E. J. Baldwin's 4th Subdivision, Book 8, Page 186 of Maps, and as more particularly described in Zone Change Application No. 5 04. " SECTION 3. The City Council does hereby find and determine that the environmental impact report for the development, as reviewed and approved for certification by the Planning Commission, after notice and public hearing, is adequate, has been prepared in accordance with the California Environmental Quality Act of 1970 and the State Guidelines and is hereby adopted by the City Council which finds that the impact of the development of the property in accordance with the development standards contained in the Medium Density Multiple Family (MF-20) Zone will not have a substantially adverse effect upon the environment of the area. SECTION 4. The zone change provided for in Section 2 of this ordinance shall become operative at the same time the revised • General Plan of the City of West Covina is adopted designating the area described in Section 2 hereto as "High Medium Density" and that the zone change for the property described in Section 2 hereto will be con- sistent with the General Plan of the City of West Covina. SECTION 5.
