Ordinance - 1311• r� L • ORDINANCE NO. 1311 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA AMENDING SECTIONS 6218, 6219, 6220, 6226.5, 6227, 6233, 6234, 6235.1 AND 6312 OF THE WEST COVINA MUNICIPAL CODE, RELATING TO BUSINESS LICENSES. The City Council of the City of West Covina does ordain as follows: SECTION 1. Section 6218 of the West Covina Municipal Code is amended to read: "6218. LICENSE ENFORCEMENT. DUTY OF CITY TREASURER. It shall be the duty of the City Treasurer to act as License Collector and he is hereby directed to enforce each and all of the provisions of this Chapter, and the Chief of Police and Special Services Officer shall render such assistance in the enforcement thereof as may from time to time be required by the City Treasurer or the City Council. The Chief of Police or the Special Services Officer may issue a notice to appear in court or secure the issuance of a complaint against.any person who is carrying on or conducting any business in violation of any of the provisions of this Code." SECTION 2.. Section 6219 of the West Covina Municipal Code is amended to read: "6219. INSPECTIONS OF BUSINESSES. The License Collector in the exercise of the duties imposed upon him hereunder, and acting through his deputies, the Special Services Officer, or duly authorized assistants, shall examine or cause to be examined all places of business in the City to ascertain whether the provisions of this Chapter have been fully complied with." SECTION 3. Section 6220 of the West Covina Municipal Code is amended to read: 116220. DEMANDING PROOF OF LICENSE CERTIFICATE. The License Collector and each and all of his assistants, the Special Services Officer, and any police officer shall have the power and authority to enter, free of charge and at any reasonable time, any place of business required to be licensed herein, and demand the exhibit of the license certificate. Any person having such license certificate theretofore issued in his possession or under his control, who willfully fails to exhibit the same on demand shall be guilty of a misdemeanor." SECTION 4. Section 6226.5 of the West Covina Municipal Code is amended to read: "6226.5. NON-PROFIT CORPORATIONS. Subject to the approval of the City Council, a license may be obtained without the payment of the fee required under the provisions of this Chapter by any non-profit corporation which is organized for recreational, social or educational purposes for the maintenance and operation of recreational, social or educational facilities within the City of West Covina. Section 6227 shall apply to the issuance of non -fee licenses under this section, except that if the License • Collector determines that the applicant qualifies for a non - fee license, he shall refer the application to the City Council for final approval or rejection." SECTION 5. Section 6227 of the West Covina Municipal Code is amended to read: "6227. ISSUANCE OF FREE PERMIT. All applications for free licenses and permits shall be referred to the License Collector, and he shall have the power in the first instance to determine the merits of such applications,,and to approve or reject the same. If he finds that said application should be approved, he shall issue to said applicant a free permit or license. If he shall reject the said license, the said applicant shall have the right of appeal to the City Council. A separate permit shall be required for each person intending to exercise any right hereunder. A charge of One Dollar shall be made for each free permit issued, which shall be used to defray the expenses of issuing the same." SECTION 6. Section 6233 of the West Covina Municipal Code is amended to read: • "6233. PEDDLERS, SOLICITORS AND JUNK DEALERS. PERMIT REQUIRED. Before any person is granted any license as a peddler or solicitor of any kind, whether entitled to an exempt license or not, or as a junk dealer, he, and each of his agents or employees who will peddle or solicit within the City, shall first furnish to the License Collector, or his authorized assistant or deputy, a written and signed appli- cation for a peddler's or solicitor's permit accompanied by an application fee of $5.00 to cover costs of investigation. No person shall peddle or solicit within the City without having on his person a valid and effective peddler's or solicitor's permit issued by the License Collector and an identification card issued by the Police Department. The Police Department shall,within a period of twenty- one days after the filing of such application, make such investigation of the applicant, agents and employees as it. deems necessary, and may in connection therewith require any such person to file a clear recent photograph of himself and be fingerprinted; and the Police Department within said period of time shall file a report of its investigation with the License Collector. The photographs, fingerprints and all data shall be filed with the permanent records of the Police Department. • If such investigation report reveals that any applicant or agent or employee has been convicted in any court of any State of the United States or in any court of the United States of: (1) Robbery; (2) Burglary; (3) Fraud or Embezzle- ment; (4) Grand theft; (5) Offenses involving narcotic drugs; -2- (6) Contributing to the delinquency of a minor, no peddler's or solicitor's permit shall be issued to such person and no peddler's,solicitor's or junk dealer's license shall be issued covering the activities of such person. If such report does not so reveal or if the Police Department so recommends, the requested permit and license shall be • issued immediately. If no report is received within said period, the permit and license shall be issued." SECTION 7. Section 6234 of the West Covina Municipal Code is amended to read: "6234. LICENSE COLLECTOR TO SIGN LICENSES. All licenses issued under and by virtue of this Chapter shall be signed by the License Collector and for the purposes of this Chapter, the City Treasurer is designated as License Collector. The License Collector shall set forth in said license the name of the party to whom the license is issued, the nature of the trade or business licensed to be pursued, the time for which the same is granted, the date thereof, the amount paid therefor and the location where said business, trade or profession is to be carried on." SECTION 8. Section 6235.1 of the West Covina Municipal Code is amended to read: "6235.1. CATEGORY CODE A. - Apartments, hotels, motels, mobile home parks, con- valescent homes, nursing homes, hospitals and businesses of • a like nature or similar character: Minimum of $40.00 per year for the first five units plus an additional $3.00 per year for each unit over five in number. Any hospital, the property of which is exempt from taxation pursuant to Section 1 c of Article XIII of the Constitution of the State of California, shall be exempt from the payment of the license fee prescribed by this section. An application for exemption shall be filed annually during the month of January. The application shall declare whether or not the property of the hospital was exempted from the payment of property taxes for the current fiscal year. The License Collector shall transmit the application to the City Council. If the application meets the requirements for exemption, the exemption shall be allowed by the City Council." SECTION 9. Section 6312 of the West Covina Municipal Code is amended to read: "6312. FIREWORKS STANDS. Stands may be erected ten days prior to the start of sale and must be removed, and the debris removed, no later than ten days after the last day of sale. A fee of $25.00 shall • be posted for each stand with the License Collector at the time of issuance of the permit. This fee will be returned if the debris and stand described above are removed within the stated time,. otherwise the fee will be used to defray the cost of cleaning up the area and will not be returned. Violation of the dates of sale will mean immediate cancellation of the permit and forfeiture of the bond." -3- • • SECTION 10. This ordinance shall become operative on the first day of the month following the month in which it becomes effective. From and after its operative date, the City Treasurer shall be and shall perform the duties of License Collector. SECTION 11. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published as required by law.
