Ordinance - 1289ORDINANCE NO.1289 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA AMENDING THE WEST COVINA MUNICIPAL CODE SO AS TO REZONE CERTAIN PREMISES AND GRANTING A VARIANCE IN CONNECTION THEREWITH (Zone Change Application No. 497, Variance • Application No. 720 - Robert Hirsch). The City Council of the City of West Covina does ordain as follows: SECTION 1. The City Council does hereby find, determine and declare that the following amendment was duly initiated, that notice of hearing thereon was duly given and published, that public hearings thereon were duly held by the Planning Commission and the City Council, that the public convenience, necessity and general welfare and good zoning practice require that the following zone change and amendment be made. SECTION 2. The West Covina Municipal Code is hereby amended by the addition thereto of a new Section 9202.2ch reading as follows: "9202.2ch. Zone Changes. Notwithstanding the provisions of Section 9202.2�.. and the zoning map referred to therein, the following premises are hereby placed and included in the Single Family Residential (R-1) Zone, Area District I, to wit: Lots 1 to 4, inclusive, of Tract No. 20551, M.B. 608-25 as filed in the office of the County Recorder of the County of Los Angeles and as more particularly described • in Zone Change Application No. 497. SECTION 3. A variance is hereby granted from certain standards established in the Single Family Residential (R-1) Zone, Area District I, consisting of a reduction in the minimum area requirements, a reduction in the minimum depth of certain lots and a reduction in the front and rear setback requirements, all as set forth in Variance Application No. 720,subject to the following conditions which shall be fully performed and completed or shall be secured by a bank or cash deposit satisfactory to the Planning Director before the use or occupancy of the property is commenced and before a certificate of occupancy is issued and the violation of any of which shall be grounds for revocation of this variance by the Planning Commission or City Council: 1. Comply with Study Plan "A" dated December 17, 1975, and Exhibit 1 except for Lot 1 which will conform with Exhibit 2. 2. Future development shall comply with all the regulations of the R-1 Zone, except where modified by Variance. 3. A six.foot masonry wall shall be constructed along Garvey Avenue and the alley. 4. Fire Department Requirements: • a. Provide steamer type hydrant as indicated on Study Plan "A". b. Provide minimum eight (8) inch main system. C. Provide on -site water supply prior to construction. This variance shall not be effective for any purpose until the owner of the property or his duly authorized representative has filed in the office of the Planning Department his affidavit stating that he is aware of and accepts all of the conditions of this variance. SECTION 4. The City Council does hereby find and declare that the negative declaration of environmental impact for the project, as adopted by the Planning Commission after notice and public hearing is adequate, has been prepared in accordance with the California Environmental Quality Act of 1970 and the State Guidelines and is hereby adopted by the City Council. SECTION 5. The City Council does hereby find and declare that the zone change for the property described in Section 2 hereof is consistent with the General Plan of the City of West Covina. SECTION 6. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published as required by law. Passed and approved this 9th day of February 1976.
