AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF WEST COVINA ADDING SECTION 4134.1
TO THE WEST COVINA MUNICIPAL CODE PROHIBITING
THE OFFERING OF VEHICLES FOR SALE FROM OFF-
STREET PARKING FACILITIES UNDER CERTAIN
CIRCUMSTANCES, DECLARING THE URGENCY HEREOF
AND PROVIDING THAT THIS ORDINANCE SHALL
TAKE EFFECT IMMEDIATELY.
The City Council of the City of West Covina does ordain
as follows:
SECTION 1. Section 4134.1 is added to the West
Covina Municipal Code to read:__

4134.1. OFFERING VEHICLES FOR SALE FROM OFF-STREET PARKING
FACILITIES PROHIBITED.
When signs not less than 17 x 22 inches in size with
lettering not less than 1 inch in height have been erected on
any off-street parking facility, whether privately or publicly
owned, giving notice of the prohibition contained in this
section, it shall be unlawful for any person to park (as that
term is defined in Section 463 of the California Vehicle Code)
any motor vehicle upon any off-street parking facility,
whether publicly or privately owned, for the purpose of selling
or offering the vehicle for sale.
If a sign containing the words "for sale" or words
of similar import is displayed on or within a motor vehicle
parked upon an off-street parking facility, whether publicly or
privately owned, it shall be presumed that the registered
owner has parked the vehicle for the purpose of selling it
or offering it for sale.
Notice of violation of the provisions of this section
shall be issued in accordance with Section 41103 of the Vehicle
Code. Section 41102 of the Vehicle Code shall apply to any
• prosecution of the registered owner charging a violation of
this section.

SECTION 2. The enactment of this ordinance is necessary
for the protection of the public peace, health and safety and it
Oshall be effective immediately upon its adoption.
The facts giving rise to the urgency hereof are as
follows:
Privately owned parking facilities open to the public
are being seriously congested by vehicles which are being offered
for sale from such parking lots. This congestion reduces the
number of parking spaces available for public use below that
required by law and creates serious problems of traffic congestion.
It is essential that this ordinance become effective immediately
to protect the motoring public and to preserve the use of parking
facilities for the purpose for which they were designed and con-
structed.
SECTION 3. This ordinance shall become effective
immediately upon its passage and the City Clerk shall certify
to the passage of this ordinance and shall cause the same to be
published as required by law.
