AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA AMENDING SECTION 9218 OF THE
WEST COVINA MUNICIPAL CODE, RELATING TO THE
GRADING AND EXCAVATION OF LAND AND DECLARING
THE URGENCY THEREOF TO TAKE EFFECT IMMEDIATELY.
The City Council of the City of West Covina does ordain
as follows:

SECTION 1. Section 9218 of the West Covina Municipal
Code is amended to read:
"9218. WHEN REQUIRED.
(a) No person shall commence any use for which an
unclassified use permit is required or any use not per-
mitted in either the R-A or R-1 Zone, and no building
permit shall be issued for any structure to be used for
or in conjunction with any such use, until a precise
plan of design covering the parcel or parcels to be
so used shall be approved and adopted as herein provided.
(b) No person shall commence the grading of or the
excavation of any land in the Hillside Overlay Zone,and
notwithstanding any provision of the Uniform Building
Code, no grading permit shall be issued for the grading
or excavation of any land in the Hillside Overlay Zone
until a precise plan of design covering the property
proposed to be graded or excavated has been approved and
adopted as herein provided.
• (c) No person shall commence the grading or
excavation of any land in the City which is not in the
Hillside Overlay Zone, and notwithstanding any provision
of the Uniform Building Code, no grading permit shall be
issued for the grading or excavation of any such land until
approval has been granted by the Building and Safety Director
and the Planning Director.
(d) The provisions of subparagraph (b) shall not
apply to the grading or excavation required in connection
with the construction of a swimming pool on property in
the R-A or R-1 Zone within the Hillside Overlay Zone."
SECTION 2. The enactment of this ordinance is necessary
for the protection of the public peace, health and safety and it
shall be effective immediately upon its adoption.
The facts giving rise to the urgency thereof are as follows:
The development of land outside of the Hillside Overlay
Zone within the City is being unnecessarily delayed and frustrated
by the precise plan requirements presently contained in Section
9218 of the West Covina Municipal Code. In order to permit needed
developments to occur, it is essential that this ordinance be
effective immediately.
• SECTION 3. This ordinance shall become effective
immediately upon its passage. The City Clerk shall certify to the
passage of this ordinance and shall cause the same to be published
as required by law.
