Ordinance - 1268ORDINANCE NO. 1268 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA AMENDING SECTIONS 9113, 9114, 9216.5, 9222.6, 9223.6, AND 9224.4 OF THE WEST COVINA MUNICIPAL CODE, RELATING TO THE TIME FOR THE HOLDING OF CERTAIN PUBLIC • HEARINGS (Amendment No. 123 - Planning Commission Resolution No. 2590). The City Council of the City of West Covina does ordain as follows: SECTION 1. Section 9113 of the West Covina Municipal Code is amended to read: "9113. TENTATIVE MAPS. (a) FILING. Each proposed subdivision or division of land shall be submitted in map form. The tentative map shall be prepared in accordance with the 'Subdivision Map Act' and the provisions of this Chapter, and shall be filed with the Planning Director. After the required number of prints of such maps are submitted to the Planning Department, they shall immediately forward one copy to all City Depart- ments, utility companies and other affected agencies, with a request that each report his recommendation, if any, to the Planning Commission A tentative map, together with required statements or other evidence shall be filed with the Planning Department not less than fifty days prior to the date of the Planning Commission meeting at which such map is to be considered. •1 (b) CITY ENGINEER'S REPORT. Within twenty days following its filing, the Planning Department shall submit a tentative map to the City Engineer. The City Engineer shall make a written report to the Planning Commission con- taining his recommendations on the tentative map. Failure to so report shall be deemed approval." SECTION 2. Section 9114 of said Code is amended to read: "9114. ALTERNATE PROCEDURE FOR FILING OF TENTATIVE PARCEL MAPS. If all of the following conditions are met, a tentative parcel map for division of land may be filed with the City Engineer's Office. The City Engineer and Planning Director are authorized after a period of not more than fifty days to approve the tentative parcel map if: (a) No street dedication is required. (b) No pavement, curb, gutter or sidewalk improvements are required. (Note: If sidewalk only is required, a bond and agreement or cash deposit may be offered in lieu thereof.) • (c) All lots are of approved size and design and the proposed parcel map will not jeopardize the orderly develop- ment of surrounding properties. If the City Engineer and Planning Director have approved the tentative parcel map pursuant to this section, the City Engineer is authorized to approve the final map if all the requirements of the tentative map are met." SECTION 3. Section 9216.5 of said Code is amended to read: "9216.5. PLANNING COMMISSION PUBLIC HEARING. Consideration of an unclassified use permit by the Planning Commission shall be in public hearing which shall • be advertised as provided in Part 24 of this Chapter and shall occur not later than sixty days after the filing of the application :' SECTION 4. Section 9222.6 of said Code is amended to read: "9222.6. SAME. TIME FOR HEARINGS. The hearing shall be held not later than sixty days following the date of filing of the.application or the passage of a resolution by the Planning Commission or the City Council." SECTION 5. Section 9223.6 of said Code is amended to read: "9223.6. SAME. TIME FOR HEARINGS. The hearing shall be held not later than sixty days following the date of filing of the application or the passage of a resolution by the Planning Commission or the City Council." SECTION 6. Section 9224.4 of said Code is amended to read: • "9224.4. SAME. SETTING HEARINGS. All proposals for amending zone boundaries or classi- fications of property uses within such zones, or unclassified use permits as are defined by this Chapter, or the granting of variances or conditional use permits as provided in this Chapter, shall be set by the Secretary of the Planning Commission for public hearing when such hearings are to be held before the Planning Commission, by the Clerk of the City Council when such hearings are to be held by it. The date of the first of the hearings shall be not less than ten days nor more than sixty days from the time of filing of an application or the adoption of a resolution, or the making of a motion." SECTION 7. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published as required by law.
