AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA AMENDING THE WEST COVINA MUNICIPAL
CODE SO AS TO REZONE CERTAIN PREMISES, DECLARING
THE URGENCY THEREOF, AND PROVIDING THAT THE SAME
SHALL BE IMMEDIATELY EFFECTIVE (Zone Change
- Application No. 490 - City Initiated).
as follows: The City Council of the City of West Covina does ordain
SECTION 1. The City Council does hereby find, determine
and declare that the following zone change and amendment was duly
initiated, that notice of hearing thereon was duly given and
published, that public hearings thereon were duly held by the
Planning Commission and the City Council, that the public convenience,
necessity and general welfare and good zoning practice require that
the following zone change and amendment be made.
SECTION 2. The West Covina Municipal Code is hereby
amended by the addition thereto of a new Section 9202.2cb- reading
as follows:
"9202.2cb Zone Changes. Notwithstanding the pro-
visions of Section 9202.2- and the zoning map referred to
therein, the following premises are hereby placed and
included in the Low Density Multiple Family Residential Zone
(MF-15) , to wit:
Those certain parcels of land generally described
as 2003, 2007, 2019, 2027, 2033, 2037, 2043, 2047,
2105, 2111, and 2117 East Garvey Avenue (Area
District I), and as more particularly described
in Zone Change Application No. 490.
SECTION 3. The City Council does hereby find and declare
that because of the substandard condition of those parcels of property
described in Section 2 hereof, the following development standards
shall be waived pursuant to Section 9205.5 of the West Covina
Municipal Code:
(a) The minimum area requirement of one acre and
the minimum depth requirement of 105 feet shall
be waived as to all parcels.
(b) The minimum width requirement of 150 feet shall
be waived as to those parcels identified as 2003
and 2.0.'97 and 2019 East Garvey Avenue.
SECTION 4. The City Council does hereby find and
declare that the environmental impact report for the project, as
adopted by the Planning Commission after notice and public hearing,
is adequate; has been prepared in accordance with the California
Environmental Quality Act of 1970 and the State Guidelines, and
is hereby adopted by the City Council which finds that the impact
of the development of the parcels of property in accordance with
• the development standards contained in the MF-15 Zone will enhance
the environment of the area.
SECTION 5. The City Council does hereby find and declare
that the zone change for the property described in Section 2 hereof
is consistent with the General Plan of the City of West Covina.

SECTION 6. The enactment of this ordinance is necessary
for the protection of the public peace, health and safety and it
shall be effective immediately upon its adoption.
The facts giving rise to the urgency hereof are as
follows:
The widening of the San Bernardino Freeway has created
a number of parcels of property which are substandard in area and
depth and which have inadequate building setback areas. By con-
solidating the parcels into blocs they may be more effectively
utilized for multiple family development. The State of California
is proposing to sell the parcels of property described in Section
2 hereof as being excess to its needs. It is essential that the
properties be developed in accordance with the zoning described
herein in order to upgrade the area and adequately protect surrounding
properties.
SECTION 7. This ordinance shall become effective immedi-
ately upon its passage and the City Clerk shall certify to the
passage of this ordinance and cause the same to be published as
required by law.
