ORDINANCE NO. 1254
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA AMENDING THE WEST COVINA MUNICIPAL
CODE BY THE ADDITION THERETO OF SECTION 4112.5
RELATING TO MOTION PICTURES.
The City Council of the City of West Covina does ordain as
follows:
SECTION 1. The West Covina Municipal Code is hereby amended
by the addition thereto of Section 4-112.5 to read as follows:
"4112.5 OBSCENE MOTION PICTURES.
Any person who produces, promotes, prepares, presents,
manages, directs, creates or participates in any exhibition
or performance of an obscene motion picture in a theatre in
the City of West Covina, shall be guilty of a misdemeanor.
For the purposes of this Section, fobscenef means that
which the average person, applying contemporary standards in
the City of West Covina, would find, taken as a whole, (1).
appeals to the prurient interests; (2) which represents,
depicts and describes, in a patently offensive way, ultimate
sexual acts, normal or perverted, actual or simulated,
masturbation, excretory functions and lewd exhibition of
the genitals, and (3) which, taken as a whole, does not
have serious literary, artistic, political or scientific
value.
For the purposes of this Section, no employee or any
person or legal entity operating a motion picture theatre
which presents such obscene exhibitional performance shall
be subject to prosecution under this Section, if the employee
is not the manager of the theatre, or an officer of such
entity, and has no financial interest in such theatre other
than receiving wages and salaries."
SECTION 2. The City Clerk shall certify to the passage
of this ordinance and shall cause the same to be published as required
by law.
