AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA PROHIBITING THE ISSUANCE OF BUILDING
PERMITS FOR THE DEVELOPMENT OF CERTAIN PROPERTIES
FRONTING UPON GARVEY AVENUE IN THE VICINITY OF
BAYMAR AVENUE EXCEPT UPON AUTHORIZATION OF THE
PLANNING COMMISSION DURING A PERIOD OF STUDY NOT
TO EXCEED 120 DAYS AND DECLARING THE URGENCY THEREOF
TO TAKE EFFECT IMMEDIATELY.
WHEREAS, Section 65858 of the Government Code of the State
of California authorizes the adoption of an interim ordinance as an
emergency measure prohibiting any 'usage of land which may be in con-
flict with a contemplated zoning proposal which the legislative body
or Planning Commission or the Planning Department is considering or
studying or intends to study within a reasonable period of time, and
WHEREAS, the Planning Commission has requested that the
development of certain properties fronting upon Garvey Avenue in
the vicinity of Baymar Avenue be suspended pending a study of the
necessity for the rezoning of those properties for multiple family
uses, and
WHEREAS, the properties in question consist of non-
conforming lots which are unsuitable for -use for single family
residential purposes;
NOW, THEREFORE, the City Council of the City of West Covina
does ordain as follows:
SECTION 1. Notwithstanding any other provisions of the West
Covina Municipal Code, no building permit shall be issued for the
construction, alteration or renovation of any single family residence
located along Garvey Avenue in the vicinity of Baymar Avenue which are
shaded in.black on the map which is attached hereto and by this
reference incorporated herein,unless the Planning Commission has
expressly approved a precise plan of development for one or more of
the parcels prepared and filed in accordance with the precise plan
procedures contained in the West Covina Municipal Code.
SECTION 2. This ordinance is declared to be an ordinance
for the immediate protection of the public health, safety and general
welfare. The facts constituting the urgency are as follows:
The properties which are the subject of this ordinance have
been acquired by the State of California in connection with the widen-
ing of the San Bernardino Freeway. The properties are non -conforming
with respect to the existing requirements for single family resi-
dential -use. In order to permit the properties to be sold by the
State and developed to their highest and best -use, it is necessary
that the zoning regulations applicable to the property be changed.
The public peace, health and safety requires that this temporary
regulation of the development of the properties be immediately effective.
SECTION 3.. This ordinance shall take effect upon its adoption
and shall continue in effect for a period of no longer than four
months, rovided, however, that after public notice pursuant to
Section 95856 of the Government Code and a public hearing, the City
Council may extend the effectiveness of this ordinance for eight
months.
SECTION 4. The City Clerk shall certify to the passage of
this ordinance and shall cause the same to be published as required
by law.
