Ordinance - 1249ORDINANCE NO. 1249 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA RELATING TO THE FILLING OF VACANCIES IN THE OFFICE OF CITY COUNCILMEN AND DECLARING THE URGENCY THEREOF TO TAKE EFFECT IMMEDIATELY. WHEREAS, because of the untimely death of Russ Nichols, a vacancy now exists on the West Covina City Council, and WHEREAS, recent changes in the State Elections Code make it impossible to hold a special election to fill the vacancy before the general election on November 5, 1974, and WHEREAS, Section 36512.2 of the Government Code authorizes a City to enact an ordinance providing that a person appointed to fill a vacancy on the City Council shall hold office only until the day upon which an election can be regularly scheduled to fill the office for the remainder of the unexpired term, and WHEREAS, the public interest would be served by the adoption of an ordinance which would authorize the filling of the vacancy on an interim basis until a special election can be held to fill the office for the remainder of the unexpired term; NOW, THEREFORE, the City Council of the City of West Covina does ordain as follows: SECTION 1. Section 2125 is added to the West Covina Municipal Code to read: 112125. COUNCILMEN VACANCIES IN OFFICE. A person appointed by the City Council to fill a vacancy on the City Council shall hold office only until the first Tuesday after the earliest date provided by law upon which a regular or special election can be held for City Council members and at which a successor is elected for the remainder of the unexpired term." SECTION 2. This ordinance is an urgency ordinance necessary for the protection of the public peace, health and safety and shall take effect immediately upon its adoption. The facts constituting the urgency are: The existing vacancy on the City Council results in the delay and inefficiency in the transaction of City business. In order to fill the vacancy at the earliest pos- sible time, subject to the right of the voters of the City to fill the vacancy, it is necessary that this ordinance be effective immediately. SECTION 3. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published as required by law. Passed and approved this 24th day of June 1974.
