Ordinance - 124540 • ORDINANCE NO. 1245 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA PROHIBITING THE ERECTION OF SIGNS UPON LARGE COMMERCIAL BUILDINGS EXCEPT THOSE WHICH COMPLY WITH THIS ORDINANCE DURING A PERIOD OF STUDY NOT TO EXCEED ONE HUNDRED TWENTY DAYS AND DECLARING THE URGENCY THEREOF, TO TAKE EFFECT IMMEDIATELY. WHEREAS, Section 65858 of the Government Code of the State of California authorizes the adoption of an interim ordinance as an emergency measure prohibiting any usage of land which may be in conflict with a contemplated zoning proposal which the legislative body, or Planning Commission, or the Planning Department is considering, or studying, -or intends to study within a reasonable period of time; and WHEREAS, the City Council has requested that the Planning Commission study the existing zoning ordinance regulating the size of signs which are permitted on large commercial buildings and recommend any changes that are necessary or desireable to encourage the development of areas zoned for regional commercial and other commercial uses within the City of West Covina; NOW, THEREFORE, The City Council of the City of West Covina does ordain as follows: SECTION 1. Notwithstanding any other provisions of the West Covina Municipal Code, no permit shall be issued for the erection of any sign upon any building in the R-C (Regional Commercial) Zone which has a floor area in excess of 75,000 square feet if the size of the sign exceeds the limitations upon size contained in Section 9213.8 of the West Covina Municipal Code, as modified, by the following formula: Building Size: Sign Area: (a) 75,000 - 99,999 square feet ADD 100 sq. ft. (b) 100,000 - 124,999 square feet ADD 150 sq. ft. ( c ) 125,000 - 149,999 square feet ADD 200 s q . f t . (d) 150,000 square feet or more ADD 250 sq. ft. SECTION 2. The Planning Director shall review and approve each application for a building permit to erect a sign upon any building in the R-C (Regional Commercial) Zone before the permit is issued. SECTION 3. This ordinance is declared to be an ordinance for the immediate protection of the public health, safety and general welfare. The facts constituting the urgency are as follows: There is a direct relationship between the size of signs and the volume of business done by retail business estab- lishments in Regional Commercial Areas. The temporary regulations contained herein are necessary to protect the economic well being of the business enterprises within the City and to avoid adverse effects upon City revenues. The protection of the public peace, health and safety require that this ordinance take effect immediately. • SECTION 4. This ordinance shall take effect upon its adoption and shall continue in effect for a period of no longer than four (4) months, provided, however, that after notice pursuant to Section 65856 of the Government Code and a public hearing, the City Council may extend the effectiveness of this ordinance for eight months. SECTION 5. The City Clerk shall certify to the passage of this ordinance and cause the same to be published in the manner required by law. Passed and approved this 22nd day of April 1974.
