ORDINANCE NO. 1243
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF WEST COVINA AMENDING SECTIONS
7504, 8112.2 AND 8112.3 OF THE WEST COVINA
MUNICIPAL CODE RELATING TO THE INSTALLATION
OF STREET LIGHTS IN CONNECTION WITH THE
DEVELOPMENT OF PROPERTY.
The City Council of the City of West Covina does
ordain as follows:
SECTION :1. Section 7504 of the West Covina Municipal
Code is amended to read:
"7504. EXCEPTIONS.
This Chapter shall not apply in the following cases:
(a) Utility lines which do not provide service to the
area being developed, redeveloped or subdivided.
(b) A single R-1 lot developed with or to be developed
with a single family residence if surrounded by improved developed
property, all of which has above -ground utilities.
(c) Temporary utility lines installed for construction
purposes prior to occupancy of a structure. (Ordinance 1025 -
1/22/68).
SECTION 2. Section 8112.2 of the West Covina Munici-
pal Code is amended to read:
"8112.2. STREET LIGHTING REQUIREMENTS
No permit shall be issued for the erection, construction,
enlargement, alteration, repair, moving or conversion of any
building upon property within the City unless a system of street
lights with underground wiring adequate to serve the property
to be improved and to meet the neighborhood needs has been
installed or provided for."
SECTION 3. Section 8112.3 of the West Covina Municipal
Code is amended to read:
"8112.3. OWNERSS RESPONSIBILITY.
Where the facilities required by Section 8112.2 do not
exist, the building official may issue the permit if the appli-
cant for the permit enters into an agreement with the City to:
(a) Grant the necessary easement and provide the
necessary trenching anal trench backfilling along the easement
for the installation of the required street lights, and
(b) Pay his fair share of the cost of the installation
of the required street lights as determined by the City Engineer.
Where the facilities required by Section 8112.2 already
exist but the lot or parcel upon which the building or structure
is to be erected or moved has not been assessed for and has not
paid its fair share of the cost of said facilities, the owner
or applicant for a permit which has a valuation exceeding $1,500,
as determined by the Building Department, shall pay to the City
the fair share of the cost of such facilities attributable to
to such lot or parcel under any reimbursement agreement or
contribution or payment by the City for such facilities.
Where a person is required to install street lights
which will also benefit property other than his own, the City
. may agree to reimburse such person as, if and when and to the
extent that it receives payment hereunder from the owner of or
applicant for a permit on the other property so benefited and
may make such reimbursement in accordance with su:oh agreement."
SECTION 4. The City Clerk shall certify to the
passage of this ordinance and shall cause the same to be
published as required by law.
