Ordinance - 1241ORDINANCE NO.1241 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA AMENDING SECTIONS 9216.2 AND 9218 OF THE WEST COVINA MUNICIPAL CODE, RELATING TO THE GRADING AND EXCAVATION OF PROPERTY AND INCLUDING CERTAIN PROPERTY IN THE HILLSIDE OVERLAY ZONE • (Amendment No. 119 - City Initiated) The City Council of the City of West Covina does ordain as follows: SECTION 1. Section 9216.2 of the West Covina Municipal Code is amended by adding paragraph (f) thereto to read: "(f) Borrow pits and stock piling sites- The -use of any parcel of land in any zone for a borrow pit or stock piling site shall only be permitted after the approval of an unclassified -use permit. As -used in this paragraph, a borrow pit is a site from which earth material is acquired for -use in grading on another site. A stock piling site is a site on which earth material is stored for eventual -use at another location." SECTION 2. Section 9218 of the West Covina Municipal Code is amended to read as follows: 119218. WHEN REQUIRED. (a) No person shall commence any -use for which an unclassified -use permit is required or any -use not per- mitted in either the R-A or R-1 Zone, and no building . permit shall be issued for any structure to be used for or in conjunction with any such 'use, until a precise plan of design covering the parcel or parcels to be so used shall be approved and adopted as herein provided. (b) No person shall commence the grading or excavation of any land, and notwithstanding any pro- vision of the Uniform Building Code, no grading permit shall be issued for the grading or excavation of any land, until a precise plan of design covering the property proposed to be graded or excavated has been approved and adopted as herein provided. This paragraph (b) shall not apply to the grading or excavation required in connection with (1) the construction of a swimming pool on property in the R-A or R-1 Zone or (2) the movement of less than 50 cubic yards of earth." SECTION 3. The zoning map referred to in Section 9202.2 of the West Covina Municipal Code is amended to include the following property in the "H" Overlay Zone: That portion of the City located south of the San Bernardino Freeway and easterly of a westerly line formed by Barranca Street, south • to Cameron Avenue, west on Cameron to Citrus Street, south on Citrus to Vine Avenue, west on Vine to Hollenbeck Street, south on Hollenbeck to Merced Avenue, west on Merced to Azusa Avenue, south on Azusa to Amar Road. SECTION 4. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published as required by law.
