Ordinance - 1225• • 0 ORDINANCE NO. 1225 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA PROHIBITING THE CONVERSION OF EXISTING APARTMENT BUILDINGS INTO CONDOMINIUM OWNERSHIP, EXCEPT ON AUTHORIZATION OF THE PLANNING COMMISSION DURING A PERIOD OF STUDY OF CONDOMINIUM DEVELOPMENT. WHEREAS, the City Planning Commission, to protect the public health, safety and welfare, is considering a revision of the zoning regulations and subdivision regulations for the conversion of existing apartment buildings into condominiums, and WHEREAS, at its meeting of August 15, 1973, the Planning Commission ordered the Planning Department to prepare suggested ordinance revisions, and WHEREAS, the Planning Commission is considering revisions of the zoning regulations and subdivision regulations for the con- version of residential buildings to condominiums, and WHEREAS, Section 65858 of the Government Code of the State of California authorizes the adoption of an interim ordinance as an emergency measure prohibiting any usage of land which may be in conflict with a contemplated zoning proposal which the legislative body, or Planning Commission, or the Planning Department is con- sidering, or studying, or intends to study within a reasonable period of time; NOW, THEREFORE, the City Council of the City of West Covina does ordain as follows: SECTION 1. Notwithstanding any other provisions of the West Covina Municipal Code, no approval shall be issued for the con- version of an apartment house into a condominium except upon the following conditions: 1. An application for a Tentative Tract Map shall be filed with the Planning Department and plans submitted therewith in accordance with the presently established procedures. 2. The plans shall be submitted to the Director of Planning for a report thereon by the Planning Director to the Planning Commission. 3. The Planning Commission shall make such review of the plans as it deems necessary; shall review the report of the Planning Director; and if it finds that said proposed development is in accordance with the proposed limitations, restrictions and recommendations of the City of West Covina and that such proposed development will not be in conflict with the proposed zoning amend- ments or land division amendments, the Planning Commission may authorize the__issuance-z of a Building Permit, or tract approval upon such conditions as it deems necessary to effect compliance with said report. SECTION 2. The provisions of this ordinance shall not apply to any condominium for which a valid Building Permit has been issued or for which there is an approved zone exception or land division as of the effective date of this ordinance. SECTION 3. This ordinance is declared to be an ordinance for the immediate protection of the public health, safety and general welfare. The facts constituting the urgency are as follows: C] There has been an increase in the requests for the con- version of apartment buildings to condominiums and the conversion will result in a lack of adequate off-street parking, visitor parking, structural amenities, noise pollution, lack of recreational area, and security devices for condominiums. SECTION 4. This ordinance shall take effect upon its adoption and shall continue in effect for a period of no longer than four (4) months, provided, however, that after notice pursuant to Section 65856 of the Government Code and a public hearing, the City Council may extend the effectiveness of this ordinance for one year. SECTION 5. The City Clerk shall certify to the passage of this ordinance and cause the same to be published in the manner required by law. Passed and approved this 27th day of . August , 1973.
