AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA DEFERRING THE OPERATIVE DATE OF
ORDINANCE NO. 1210, PROVIDING FOR THE PAYMENT
OF ONE-HALF OF THE ADDITIONAL BUSINESS IMPROVEMENT
• AREA TAX FOR THE PERIOD FROM JULY 1, 1973 TO
DECEMBER 3J, 19732 AND PRESCRIBING THE PROCEDURE
THEREFOR, AND DECLARING THE URGENCY OF THIS
ORDINANCE AND PROVIDING THAT IT SHALL TAKE
EFFECT IMMEDIATELY.
The City Council of the City of West Covina does ordain
as follows:
SECTION 1. Section 6264 of the West Covina Municipal
Code, as added by Ordinance No. 1210 and entitled "ORDINANCE OF THE
CITY COUNCIL OF THE CITY OF WEST COVINA ESTABLISHING A BUSINESS
IMPROVEMENT AREA TO BE KNOWN AS 'BUSINESS IMPROVEMENT AREA OF THE
CITY OF WEST COVINA', FIXING THE BOUNDARIES THEREOF, FIXING THE
ADDITIONAL LEVY OF LICENSE TAXES TO BE IMPOSED ON THE BUSINESSES
IN SUCH AREA AND ADDING CHAPTER 2.5 TO PART VI, OF THE WEST COVINA
MUNICIPAL CODE ENTITLED 'BUSINESS IMPROVEMENT"" is amended to read:
"6264 . PAYMENT.
On July 1, 1973 fifty percent of the additional
business license tax levied by this Chapter shall become
due and payable by each holder of a business license which
is to be effective during the period of July 1, 1973 to
December 31, 1973. The License Collector shall mail to
each licensee a statement of the amount of the additional
business license tax which is payable by each such licensee
commencing July 1, 1973.
Any business license issued pursuant to Chapter 2 of
this Part shall cease to be effective for any purpose if
the licensee fails to pay, when due, the full amount of the
additional business license tax levied by this Chapter.
Except as otherwise provided in this Section, the
additional business license tax levied by this Chapter shall
be due and payable and shall be collected at the same time
and in the same manner as the ordinary business license tax
of the City."
SECTION 2. Section 6268 of the West Covina Municipal
Code, as adopted by said Ordinance No. 1210, is amended to read:
"6268. EFFECTIVE DATE.
This Chapter shall become operative and shall be
in full force and operation from and after July 1, 1973."
SECTION 3. Sections 1 and 2 of this ordinance shall become
operative at the same time that Ordinance No. 1210 becomes operative
and said Sections shall be in full force and operation from and
• after that time.
SECTION 4. This ordinance is necessary for the protection
of the public safety, health and welfare and shall be effective upon
the date of its adoption.
The facts constit-Ing its urgency are:
The City is dependent upon the revenue from business
license fees for the payment of its usual and necessary expenses.
In order to provide for the orderly implementation of the Business
Improvement Area without interference with the.issuance of regular
business licenses on a calendar year basis it is necessary that
this ordinance take immediate effect.
• SECTION 5. The City Clerk shall certify to the passage
of this ordinance and shall cause the same to be published as
required by law.
