Ordinance - 1166ORDINANCE NO. 1166 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA ADDING PART 33 TO CHAPTER 2 OF ARTICLE.IX OF THE WEST COVINA MUNICIPAL CODE CREATING THE CIVIC CENTER OVERLAY ZONE. (Amendment No. 113) . The City Council of the City of West Covina does ordain as follows: SECTION 1. Part 33 consisting of Sections 9233 to 9233.7, inclusive, is hereby added to Chapter 2 of Article IX of the West Covina Municipal. Code to read. as follows: "PART 33 - CIVIC CENTER OVERLAY ZONE 9233• CIVIC CENTER OVERLAY ZONE. PURPOSE. The purpose of the Civic Center Overlay Zone is to provide for the orderly, harmonious, and attractive development of the area around the public buildings in the Civic Center in order to protect and preserve the character and integrity of the public and private investment and to encourage the devel- opment of the area as a focal point for the community. The regulations contained in this Part are in addition to those in the underlying zones which are applicable to the property in the Civic Center Area. 9233.1• LOCATION. The Civic Center Area consists of the property in the Civic Center Area as specified in Section 9217.8 including: All land lying between the center line of San Bernardino Freeway; a line 350 feet easterly of the most center line of Sunset Avenue; a line 335 feet southerly of the center line of Cameron Avenue (80 feet wide); the most westerly property line of Orange Avenue, exclusive of any portion thereof lying southerly of the northwesterly line of the Walnut Creek Wash.. 9233.2. DEVELOPMENT STANDARDS. The following development standards, in addition to the requirements of the underlying zone, shall apply to all devel- opment within the Civic Center Overlay Zone. (a) Precise Plan of Design Before property in the Civic Center Overlay Zone is developed or improved, a Precise Plan of Design will be required as specified in Section 9218. (b) Architectural Treatment The Planning Commission and the City Council shall consider the exterior architectural design and appearance, signage, landscaping, and other physical characteristics, including location and type of public utility facilities pro- posed to be constructed in the Civic Center Overlay Zone. A scale elevation of each exposed side, as well as at least one perspective and samples of the surface materials, shall be submitted with the application for approval of the Precise Plan of Design and shall become an integral part of such application.. -1- 1. The exterior architectural design and appearance shall include strong vertical and horizontal lines to convey a definite feeling of massiveness and volume. Building . walls should be the dominant architectural form; roofs should be a secondary element, preferably flat with moderate parapets. Exposed side and rear walls shall be finished in the same style, design, and materials as the front of the building. 2. The color of building and screening walls shall be limited to brick red, white, or earth tones. 3. The'surface materials shall be smooth concrete and brick with accents of rough sawn redwood, textured concrete, stucco textured plaster or other similar material as approved by the Planning Commission. 4. Roof surfaces of all structures shall include a design element consisting of patterns, materials, and shall be finished as though it will be viewed from above. 5. Exterior Lighting A. Parking lot light standards shall be of the same or similar size and design as those in the Civic Center complex. B. All other luminaries shall be designed and placed to complement the develop- ment by respecting structural modules, roof lines, and landscape layout. Preference should be given to concealed, wall -mounted or recessed fixtures which eliminate the clutter of poles and elaborate frames. Glare and distraction should be minimized wherever possible by the use of diffused or indirect light. 6. Landscaping shall include the City flower, Agapantha, and at least one of the following: Pyrus kawakami, Pinus canariensis, or Eucalyptus citriodora, as well as other complementary trees, shrubs, and ground covers. A permanent, auto- matic irrigation system shall be installed in all planter areas. 7. All screening walls shall be of the same or coordinated color and material as the • building. -2- 0 • (c) Yards Parking shall not be allowed in the required front yard setback which shall be landscaped. (d ) Refuse Storage All trash, garbage, and refuse storage areas shall be within a fully enclosed structure of the same color and material finish as the building. (e) Mechanical Equipment All mechanical equipment and vents shall be completely screened behind a permanent structure and all roof top mechanical equipment shall be completely screened from all views, including that from above. (f ) Signs All signs shall be considered by the Planning Commission at the time of the Precise Plan review for the development, except in the case of existing structures when only the sign or sign copy is being changed. In the case of a sign change or copy change only�,-the Planning Director shall review the change subject ?oKhe conditions of this Section and shall make all approved plans and specifications part of the Precise Plan file for the development. In addition to the signs allowed in the underlying zone, a ground sign will be allowed in the front yart setback. It shall be of the same architectural style as the building, no higher than four (4) feet from finished grade level, and placed within a permanently landscaped area of not less than twenty-four (24) square feet. The square footage of each face, ,however, shall in no case exceed that amount allowed on the front of the building and shall be subtracted therefrom. Roof signs are prohibited within the Civic Center Overlay Zone. 9233.5 USES PERMITTED. Any lot or premises located in the Civic Center Overlay Zone may be used for any purpose allowed as a matter of right in the underlying zone which applies, except for those uses which are prohibited by Section 9233.6. 9233.6. USES PROHIBITED. The following uses are prohibited in the Civic Center Overlay Zone: (a) Retail establishments engaged in the sale of liquor pursuant to an on -sale general license which are not being operated in conjunction with a bona fide eating place as defined in Section 23038 of the California Business and Professions Code. -3- (b) Newspaper stands or vending machines not fully enclosed within a building, or not coordinated and approved with the Precise Plan of Design for the property. (c) Outdoor amusement devices, vending machines, and weighing scales. (b) Barber and beauty colleges. (e) Outdoor display and sales uses of the following types: 1. Agricultural, industrial, and construction equipment sales and rentals. 2. Automobile, motorcycle, or truck sales (new or used) including related servicing and repair. 3. Automobile or truck trailer sales or rentals. 4. Boat sales (new or used) including related servicing and repairs. 5. Building material sales. 6. Mobile home sales.or rentals. 7. Plant nurseries and related packaged sales or storage. 8. Swimming pool sales and service. (f) Recreational and entertainment facilities of the following types: 1. Outdoor, athletic club activities. 2. Family billiard parlors. 3. Slot car racing. (g) retail sales of the following types: 1. Auto, tire, and auto accessory stores, except as accessory to a permitted use. 2. Pawn Shops. 3. Second-hand stores. (h) Service establishments of the following types: • 1. Bulk or self-service dry cleaning or laundry facilities. 2. Reducing salons. 3. Massage parlors (includes sauna bath). 9233.7 REQUIRED TERMINATION OF NON -CONFORMING USES. All uses in existence on the date of the adoption of this Part which do not conform to the provisions hereof shall . be removed, or altered, or replaced, so as to conform with the provisions of this Part within ten (10) years of the date of the adoption of this Part." SECTION 2. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published as required by law. Passed and approved this 24th day of May 1971.
