AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA
PROHIBITING THE MOVING OF BUILDINGS OR STRUCTURES ONTO LAND
IN THE CITY ZONED R-A OR R-1.
The City Council of the City of West Covina does ordain
as follows:
WHEREAS, the City Council, to protect the public
health, safety, and welfare, is considering a revision of
the permissible uses of land with respect to the moving of
buildings or structures onto property zoned R-A and R-1; and
WHEREAS, Section 65858 of the California Government
Code authorizes the adoption of an interim ordinance prohibiting
any usage of land which may be in conflict with the contemplated
zoning proposal which the legislative body, planning commission,
or planning department is considering or studying or intends
to study within a reasonable amount of time;
NOW, THEREFORE, the City Council of the City of
West Covina does hereby ordain as follows:
SECTION 1. Notwithstanding any provision now
contained in Article IX of the West Covina Municipal Code
or elsewhere in said Code, the use of any land zoned R-A or
R-1 in the City for the purpose of moving a building or struc-
ture onto said land is hereby prohibited until such time as
the City Council determines whether the existing provisions of
the zoning regulations should be amended to regulate such use
in order to protect the public health, safety, and welfare.
SECTION 2. No building permit shall hereafter be
issued for the moving of any building or structure onto property
zoned R-A or R-1 in the City.
SECTION 3. This ordinance is declared to be an
ordinance for the immediate protection of the public health,
safety and general welfare, the facts constituting the urgency
are as follows:
It has been revealed that the present
zoning regulations do not adequately
regulate the moving of buildings or
structures onto property zoned R-A or
R-1 in the City. The matter is presently
set for study by the Planning Commission
of the City. Since it is urgent that the
proper regulations be established govern-
ing the moving of buildings or structures
onto property zoned R-A or R-1 in order
to protect the public health, safety, and
general welfare, it is essential that suf-
ficient time be provided to permit the
Planning Commission and the City Council
to conduct such study and hold all public
hearings in connection therewith.
SECTION 4. This ordinance, being an urgency ordinance
for the immediate protection of the public safety, health, and
general welfare, containing a declaration of the facts.- con-
stituting the urgency and passed by a four -fifths (4/5)' vote
of the Council, shall become effective immediately upon its
adoption.
SECTION 5. The City Clerk shall certify to the
passage of this ordinance and shall cause same to be published
as required by law.
