Ordinance - 1123f ORDINANCE NO. 1123 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA AMENDING SECTIONS 7200, 7219, 7221, 7237, 7239, 7241 AND 7242 OF THE WEST COVINA MUNICIPAL CODE RELATING TO EXCAVATIONS IN PUBLIC STREETS. The City Council of the City of West Covina does ordain as follows: SECTION 1. The first paragraph of Section 7200 of the West Covina Municipal Code is amended to read: "For the purpose of this Chapter the following words and phrases are defined, and shall be construed as hereinafter set out, unless it shall be apparent from the context that they have a different meaning. Whenever in this Chapter reference is made to 'Standard Specifications for Public Works Construction', it shall mean the latest edition thereof which has been adopted by the City Council and is on file in the office of the City Clerk. The definitions contained in the 'Standard Specifi- cations for Public Works Construction' which are not in con- flict with the definitions in this Section shall also apply to the words and phrases used in this Chapter.1° SECTION 2. Subparagraphs (q) and (r) of Section 7200 of said code are amended to read, respectively, as follows: "(q) SAND EQUIVALENT VALUE shall be determined in accordance with Section 211-3 of said 'Standard Specifications for Public Works Construction'. • (r) RELATIVE COMPACTION shall be determined in accord- ance with Section 211-2 of said 'Standard Specifications for Public Works Construction'." SECTION 3. Subparagraph (c) of Section 7219 of said code is amended to read: "(c) The cost to the City of resurfacing the street, alley, sidewalk or other public place, calculated on the following basis: ASPHALT PAVEMENT Select system streets - 70,d per square feet with a $20.00 minimum; all other streets - 50¢ per square foot with a $20.00 minimum. CONCRETE PAVEMENT All streets - $2.00 per square foot with a $20.00 minimum. SIDEWALKS All sidewalks - 60� per square foot." " SECTION 4. Section 7221 of said code is amended to read: 7221. DEPOSITS. Any person intending to make any excavation in any street, alley or other public place, shall make and maintain with the City Clerk a deposit of One Thousand Dollars which shall permit the issuance of permits up to five thousand square feet per c s • • month, and a deposit of twenty cents per square foot for all excavations in excess of five thousand square feet per month; or a deposit equal to twice the total amount of all fees and estimated costs of resurfacing as set forth in Sections 7219, 7220 and 7241 for each permit up to three permits per month." SECTION 5. The first paragraph of Section 7237 of said code is amended to read: "All excavations made within existing or future public rights of way shall be backfilled in such a manner as to con- form with Section 306-1 of the 'Standard Specifications for Public Works Construction'." SECTION 6. Section 7239 of said code is amended to read: "7239. RESURFACING REQUIREMENTS. The City shall resurface all portions of the street, alley, sidewalk or other paved public place damaged, destroyed or removed by any permittee in connection with his excavation, construction or other operations. At the time application is made for a permit for any street excavation by a public agency or a public utility or by a contractor for a public agency or public utility, the City Engineer may authorize the permittee to resurface all portions of any street, alley, sidewalk or other paved public place damaged, destroyed or removed by the permittee in connection with his excavation, construction or other operations. All such resurfacing work shall be done in accordance with the 'Standard Specifications for Public Works Construction'." SECTION 7. Section 7241 of said code is amended to read: 117241. CITY MAY RESURFACE EXCAVATIONS. After the backfilling of an excavation, if the permittee fails or refuses to resurface that portion of the surface of the pavement damaged by him in accordance with the requirements of his permit or of Section 7239, the City may do such resur- facing. The cost of such resurfacing shall be charged against the permittee, except in,those instances where the permittee's excavation is within an area of pavement to be immediately reconstructed by the City, and the resurfacing of the excavation is an integral part of the general. City improvement. All costs for resurfacing shall,be computed in accordance with Section 7219." SECTION 8. Section 7242 of said code is amended to read: "7242. MATERIALS AND CONSTRUCTION TO MEET STANDARD SPECIFICATIONS. All material used in any work done under the provisions of this Chapter shall be new, first class material and shall conform to, and the manner of construction shall meet all of the requirements prescribed by this Chapter or by the 'Standard Specifications for Public Works Construction'. The City Engineer may order tests of any material at the expense of the permittee, to determine whether said materials meet said Standard Specifications." SECTION 9.
