AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA AMENDING SECTIONS 9212, 9212.9, 9216.2
AND 9227.3 OF THE WEST COVINA MUNICIPAL CODE RELATING
TO DRIVE-IN AND DRIVE -THROUGH USES OF PROPERTY.(Amendment #106)
The City Council of the City of West Covina does ordain as
follows:
SECTION 1. Subparagraph (f) of Section 9212 of the West Covina
Municipal Code is amended to read:
"(f) Restaurants (indoor seating only)."
SECTION 2. Subparagraph (h) of Section 9212.9 of said code
is amended by repealing and deleting item 11 thereof and by amending item
23 thereof to read: 11
"23. Restaurants (indoor seating only - includes cabaret
dancing with maximum floor size of 500 square feet)."
SECTION 3. Section 9216.2 of said code is amended by adding
the following paragraphs at the end of said section:
"(c) Drive-in, drive -through, walk-up commercial uses (or
any combination thereof) may only be established and maintained
in the C-2, C-C, C-3, R-C, S-C, and M-1 Zones after an unclassified
use permit has been granted. The establishment or maintenance of
drive-in, drive -through, walk-up commercial uses (or any combination
thereof) in any other zone is prohibited.
• (d) Outdoor restaurants may only be established and maintained
in the N-C, C-21 C-C, C-3, R-C, S-C, and M-1 Zones after an unclassi-
fied use permit has been granted. The establishment or maintenance
of an outdoor restaurant in any other zone is prohibited."
SECTION 4. Subparagraph (g) of Section 9227.3 of said code
is amended by repealing and deleting item 14 thereof.
SECTION 5. Subparagraph (h) of Section 9227.3'is amended by
repealing and deleting item 9 thereof and amending item 21 thereof to read:
"21. Restaurants (indoor seating only - includes cabaret
dancing with maximum floor size of 500 square feet)."
SECTION 6. The City Clerk shall certify to the passage of this
ordinance and shall cause the same to be published as required by law.
