Ordinance - 1109ORDINANCE NO. 1109 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA ADDING CHAPTER 4.6 TO ARTICLE II OF THE WEST COVINA MUNICIPAL CODE PROVIDING FOR REIMBURSEMENT FOR DAMAGE TO PROPERTY OF EMPLOYEES. The City Council of the City of West Covina does ordain as follows: SECTION 1. Chapter 4.6 consisting of Sections 2475 to 2478 inclusive,`,.is hereby added to Article II of the West Covina Municipal Code to read: "CHAPTER 4.6 - REIMBURSEMENT FOR DAMAGE TO PROPERTY OF EMPLOYEES. 2475. SCOPE Pursuant to Section 53240 of the Government Code and pursuant to the procedures and limitations contained in this Article, the City will pay the current market value or the cost of replacing or repairing property or prostheses of City employees such as eyeglasses, hearing aids, dentures, watches and articles of clothing necessarily worn or carried by such employees when such items are damaged in the line of duty without fault of such employee and not due to the negligence of any person. 2476. CLAIMS. An employee requesting reimbursement pursuant to this Chapter shall submit his verified claim therefor upon a form supplied by the City Clerk to his Department Head. The claim shall be filed within ten days after he becomes aware of the damage or destruction of the property or prostheses unless prevented by is disability, act of God, or other good reason, and the Department Head so finds. The claim shall be accompanied by proof of the current value of the property of prostheses damaged or destroyed and the cost of repairs and replacement. 2477. ACTION UPON CLAIMS. If the Department Head determines that the property or prostheses referred to in the claim was necessarily worn or carried by the employee, was damaged in the line of duty without fault of the employee and not due to the negligence of any person, he shall recommend to the City Manager that the claim be allowed. If the City Manager finds that the employee is entitled to reimbursement, he shall approve the claim and authorize its payment if the amount claimed does not exceed $200.00. If the amount claimed exceeds $200.00, the City Manager shall recommend to the City Council that the claim be allowed. If the City Council determines that the City employee is entitled to reimbursement, it shall approve the claim and authorize its payment in the amount determined to be due. The denial of a claim by either the Department Head, the City Manager or City Council shall be final and not subject to review. 2478. AMOUNT ALLOWABLE. it If an employee is entitled to reimbursement under this Chapter, the amount of reimbursement shall be the current market value of the property or prostheses damaged or destroyed or the cost of its repair or replacement, whichever is less." 4 D SECTION 2.
