AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA AMENDING SECTION 3195.4 OF THE WEST
COVINA MUNICIPAL CODE RELATING TO PARADE PERMITS
AND DECLARING THE URGENCY THEREOF TO TAKE EFFECT
IMMEDIATELY.
The City Council of the City of West Covina does ordain as
follows:
SECTION 1. Section 3195.4 of the West Covina Municipal Code
is amended to read:
"3195.4. APPROVAL OR REJECTION.
The City Council shall approve or disapprove the application
for a parade permit according to the foregoing standards. If the
City Council approves the application, the City Clerk shall mail
to the applicant without delay a notice of the action and shall advise
the applicant that when a cash or surety bond in the amount of $5,000
conditioned upon the payment by the applicant or by the surety,upon
the applicant's failure to do so, of the amount up to the principal
amount of the bond, of any damage to public or private property
proximately caused by the conduct of the parade or by any partici-
pant therein, the permit shall be issued.
If the City Council disapproves the application, the City Clerk
shall mail to the applicant without delay a notice of the action
stating the reasons for the denial of the permit.
In his application the applicant may request that the posting
of bond be waived. The City Council may authorize the waiver if it
• finds that the size of the parade, its purpose and the manner in
which it is to be conducted is not reasonably likely to cause injury
to property by provoking disorderly conduct or creating a disturbance.
SECTION 2. 'This ordinance is necessary for the immediate
preservation of the public peace, health or safety and shall be effective
upon the date of its adoption. The facts constituting its urgency are:
Recent applications for parade permits on behalf of groups which are un-
organized and have no effective plans for the organization and direction
of the parade or the participants therein require that adequate City con-
trols be established for the protection of property and the protection of
the public peace and safety.
SECTION 3. The City Clerk shall certify to the passage of
this ordinance and shall cause the same to be published as required by
law.
