Ordinance - 1100v ORDINANCE NO. 1100 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA REPEALING SECTIONS 4305, 4305.1 AND 4305.2 OF, AMENDING SECTIONS 9201, 9203, 9204 AND 9216.2 OF, AND ADDING SECTIONS 9228.2 AND 9228.2.1 TO, THE WEST COVINA MUNICIPAL CODE RELATING TO HOBBY KENNELS AND THE KEEPING OF HOUSEHOLD PETS. (Amendment No.99) The City Council of the City of West Covina does ordain as follows: SECTION 1. Sections 4305, 4305.1 and 4305.2 of the West Covina Municipal Code are hereby repealed. SECTION 2. Section 9201 of said code is amended as follows: a. After the definition of "ADVERTISING SIGN" insert: "ADULT CAT OR ADULT DOG.- Any dog or cat over four months of age." b. After the definition of "BLOCK" insert: "BOARDING KENNEL.- The keeping or harboring at any one time, at one or more locations, one or more dogs as a business. c. After the definition of "DETACHED SIGN" insert: "DOG -PROOF FENCE.- A fence six feet high of heavy gauge chain link, masonry block, or comparable weatherproof material, or a combination thereof, with a footing which is at least four • inches wide and twelve inches deep, below grade." d. After the definition of "GUEST HOUSE OR ACCESSORY LIVING QUARTERS" insert: "HOBBY KENNEL.- The owning, keeping or harboring for show or breeding purposes of four or more dogs over the age of four months,maintained on the same lot"and incidental to the occupancy of the lot for residential purposes, but shall exclude boarding kennels." e. Strike out and repeal the following definition: "KENNEL.- A place where five or more adult dogs are kept, whether by owners of dogs or by persons providing facilities and care for compensation. An adult dog is a canine of either sex, altered or unaltered, that has reached the age of four months." SECTION 3. Section 9203 of said code is amended by amend- ing subparagraph (d) - 1 to read: "l. HOUSEHOLD PETS: Provided that not more than three adult dogs may be kept on any lot unless an unclassified use permit has been granted authorizing the development, maintenance and operation of a hobby kennel on the lot, and provided further that . not more than four adult cats may be kept on any lot at any one time." SECTION 4. Section 9204 of said code is amended by amending subparagraph (d) - 1 to read: "l. HOUSEHOLD PETS: Provided that not more than three adult dogs may be kept on any lot unless an unclassified use permit has been granted authorizing the development, maintenance and operation of a hobby kennel on the lot, and provided further that.not more than four adult cats may be kept on any lot at any one time." SECTION 5. Section 9216.2 of said code is amended by adding the following paragraph at the end of said section: "(a) A hobby kennel may only be established and maintained in the R-A or R-1 Zones after an unclassified use permit has been granted. The establishment of a hobby kennel in any other zone is prohibited." SECTION 6. Section 9228.2 is added to said code to read: "9228.2. HOBBY KENNEL REGULATIONS. The purpose of the hobby kennel regulations is to provide the dog -fancier the opportunity to own, keep, or harbor, four or more dogs for show or breeding purposes incidental to a residential use. Such regulations are intended to provide protection for the health, safety, and welfare of adjacent property owners." SECTION 7. Section 9228.2.1 is added to said code to read: "9228.2.1 DEVELOPMENT.STANDARDS. The following standards are applicable to the development, maintenance and operation of hobby kennels. The Planning Com- mission may, based upon compliance with said standards, approve • or deny a request for a hobby kennel. a. ZONING. Hobby kennels shall be established only on land that is zoned R-A or R-1. b. UNCLASSIFIED USE PERMIT. An unclassified use permit shall be obtained prior to establishing a hobby kennel (as specified in Section 9216 of.the Zoning Ordinance). The application for such permit shall include a plot plan showing all existing and proposed structures, dog runs, landscaping and walls. c. SITE SIZE. Hobby kennels may only be located on a site of 10,000 square feet or more. d. CONSTRUCTION OF BUILDINGS. Any building to be used for a kennel shall be insulated with a sound proofing material. e. WALLS. All areas utilized for kennel purposes shall be screened with a 'dog -proof fence'. Open run areas shall be screened from abutting properties with a six foot high 'dog -proof' heavy guage chain link fence, and a minimum two foot wide buffer strip of landscaping materials appropriate in type and size to create a solid plant screen or by a six foot high solid masonry or wood wall. Landscaping materials shall be approved by the Planning Director or his representative. f. LITTERS. The owner of dogs maintained in a hobby kennel shall be permitted to maintain a litter of pups through the weaning stage, but not longer than four. months. -2- • -J f After the age of four months, any pups remaining on the premises shall be considered as adult dogs and shall be allowed only if the total number of dogs (including pups over the age of four months) does not exceed the maximum number allowed under Sections 9203 (d)-1 and 9204 (d)-1 of the Zoning Ordinance, or the maximum allowed under the terms and conditions of the unclassified use permit. Sales of pups shall be permitted from the premises. If all pups have not been sold prior to the age of four months, the owner may request a thirty -day time extension. Such request shall be in writing and shall include reasons for the request and shall be subject to approval by the Planning Director." SECTION 8. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published as required by law.
