ORDINANCE NO.. 1057
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA AMENDING SECTIONS 4108 AND 4109 OF,
AND ADDING SECTIONS 4109.2 AND 4109.3 TO THE
WEST COVINA MUNICIPAL CODE PROHIBITING UNREASONABLE
LOITERING AND INTERFERENCE WITH TRAVEL UPON PUBLIC
WAYS.
The City Council.of the City of West Covina does ordain as
follows:
SECTION 1. Section 4108 of the West Covina Municipal Code
is amended to read:
114108. PICKETING. MASS DEMONSTRATIONS.
It shall be unlawful for any person, singly or in concert
with others, to engage in picketing or mass demonstrations in such
a manner as to obstruct or unreasonably interfere with free ingress
or egress to or from any public premises or place of business or
employment or so as to obstruct or unreasonably interfere with
the free use of public streets, sidewalks, alleys or other public
ways adjacent or contiguous thereto."
SECTION 2. Section 4109 of the West Covina Municipal Code
is amended to read:
"4109. LOITERING. UNREASONABLE OBSTRUCTION OF STREETS.
It is unlawful for any person to loiter. or stand in or upon
any public street, alley, sidewalk or cross walk or other public
• way open for pedestrian travel, or otherwise occupy any portion
thereof in such a manner as to unreasonably annoy or molest any
pedestrian thereon or as to obstruct or unreasonably interfere
with the free passage of pedestrians.
It is unlawful for any person to loiter, stand or sit in
or at the entrance of any church, hall, theatre., moving picture
theatre or place of public assemblage so as. to obstruct such
entrance:"
SECTION 3. Section 4109.2 is added to the West Covina
Municipal Code to read:
114109.2. SITTING OR LYING ON PUBLIC WAYS.
It is unlawful for any person to sit, lie or sleep in or
upon any public street, alley, sidewalk or cross walk or other
public way open for pedestrian travel.
The provisions of this section do not prohibit a person
from sitting upon a public street, alley or sidewalk or cross walk
or other public way open for pedestrian travel if:
(a) Necessitated by the physical disability of such person,
or
• (b) Viewing a legally conducted parade, or
(c) On a bench lawfully installed for such purpose."
SECTION 4. Section 4109.3 is added to the West Covina
Municipal Code to read:

114109.3. LEAVING ARTICLES ON STREETS.
It is unlawful for any person to leave or permit to remain
on any public street, alley, sidewalk, cross walk or other public
way open for pedestrian travel, any merchandise, baggage or any
article of personal property.
Nothing in this section shall prevent leaving a temporary
rack or stand used for the purpose of displaying newspapers for
sale while such rack or stand is so used if such rack or stand does
not occupy any portion of the street set aside for vehicular use
and such rack or stand does not cover an area exceeding ten square
feet."
SECTION 5. The City Clerk shall certify to the passage of
this ordinance and shall cause the same to be published as required by
law.
