Ordinance - 990ORDINANCE NO. 990 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA AMENDING THE ZONING CHAPTER OF THE WEST COVINA MUNICIPAL CODE TO CREATE A NEW AREA • DISTRICT IA AND PRESCRIBE REGULATIONS THEREFOR, AND DECLARING THIS TO BE AN URGENCY ORDINANCE. The City Council of the City of West Covina does ordain as follows: SECTION 1. Paragraph (b) of Section 9204 of the West Covina.Municipal Code is hereby amended to read as follows: "(b) Buildings. No building shall occupy any portion of a required front or side yard, and in the case of reversed corner lots, no building shall be erected upon such lot closer than 5 feet in Area District I and IA, 7 feet in Area District II, IIA, and III, and 10 feet in Area District IV and V to the property line of the required side yard of the abutting lot to the rear, nor closer to the street side property line than a distance representing one-half the required front yard of the lot to the rear in the required rear yard. On any lot, no building shall be located within 5 feet of the rear property line." SECTION 2. Section 9204.1 of the West Covina Municipal • Code is hereby amended to read as follows: "9204.1 HEIGHT. No building or structure in the R-1 Zone shall exceed twenty-five feet in height or two stories. Within twenty-five feet of the front lot line, within th?=rty-five feet of the rear lot line, and within ten feet of a aide lot line in Area Districts I, IA, II and IIA and fifteen feet of a side lot line in any other area district, no building or structure shall exceed eighteen feet in height." SECTION 3. Section 9204.2 of the West Covina Municipal Code is hereby amended to read as follows: "9204.2 FRONT YARD. Every lot or parcel in Zone R-1 shall have a front yard not less than twenty-five feet, except that in Area District IA the front yard shall be not less than twenty feet." SECTION 4. Item 1 of Paragraph.(a) of Section 9204.3 of the West Covina*Municipal Code is hereby amended to read as • follows: "1. Five feet in Area Districts I and IA." SECTION 5. Section 92014,4 of the West Covina Municipal Code is hereby amended to read as follows: "92o 4.L4 REAR YARD. . Every lot in the R-1 Zone shall have a required rear yard of twenty-five feet, except that in Area District IA the yard shall be not less than fifteen feet." SECTION 6. Section 92014.6 of the West Covina Municipal Code is hereby amended to read as follows: "92o 4.6 GROUND COVERAGE. Maximum ground coverage of all structures in Zone R-1 shall not exceed 35% of the total lot or parcel area, except in Area District IA." SECTION 7. A new Section 9217..2.1 is hereby added to the West Covina Municipal Code reading as follows: "9217.2.1 SAME. AREA DISTRICT IA The lot or parcel area required in Area District IA shall be a minimum of six thousand square feet and no lot or parcel shall be less than fifty feet in width, provided, however, that • no lot or parcel shall be less than ninety- five feet in depth, In Area District IA the area of the dwelling enclosed within the exterior walls of the main building shall be not less than nine hundred square feet, exclusive of garages and porches." SECTION 8. This ordinance is for the immediate preservation of the public peace, health and safety and shall be effective immediately upon its adoption. The facts constituting the urgency are as follows: Certain areas are in the process of annexation to the City. The determination of the annexation will be completed before a regular ordinance would take effect. The development within the proposed annexed area does not comply with any existing Area District within the City and upon annexation would immediately violate the West Covina Municipal Code unless this ordinance is adopted effective immediately. SECTION 9. The City Clerk shall certify to the passage of this ordinance and cause the same to be published as required by law. Passed and approved this 27th day of February, 1967.
