Ordinance - 1016ORDINANCE NO. 1016 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA AMENDING CERTAIN PROVISIONS OF THE WEST COVINA MUNICIPAL CODE RELATING TO BUSINESS LICENSES. The City Council of the City of West Covina does ordain as • follows: SECTION 1. Section 6201 of the West Covina Municipal Code is hereby amended to read as follows: 116201. BUSINESS LICENSES REQUIRED. No person shall commence to carry on or carry on any business, show, exhibition, game, occupation, profession, or enterprise in the City, without having first procured from the City a license to do so, or without complying with all regulations of such business, show, exhibition, game, occupation, profession, or enterprise con- tained in this Code; and the carrying on of any such business, show, exhibition, game, occupation, profession or enterprise without first having procured a license from said City to do so, or without complying with any and all regulations of such business, show, exhibition, game, occupation, profession, or enterprise contained in this Code shall constitute a separate violation of this Code for each and every day that such business, show, exhibition, game, occupation, profession, or enterprise is so carried on." SECTION 2. Section 6205 of the West Covina Municipal Code is hereby amended to read as follows: . 116205. LICENSES NONTRANSFERABLE. No license granted or issued under the provision of this Chapter shall be in any manner transferred or assigned, nor shall it authorize any person other than those therein mentioned or named to do business, without the written consent of the License Collector endorsed thereon; at the time any such license is assigned or transferred, the person applying for such transfer or assignment shall make application for a license showing that he is continuing the same business already licensed and paying a transfer fee of Five Dollars." SECTION 3. Section 6206 of the West Covina Municipal Code is.hereby amended to read as follows: 116206. DEFINING A FIXED PLACE OF BUSINESS. A fixed place of business is, for the purpose of this Chapter, defined as a location in the City at which is kept a substantial stock of merchandise or equipment generally kept in connection with business of like nature or character and upon which city and county taxes are assessed and paid, or any established physical location within the City." SECTION 4. Section 6213 of the West Covina Municipal Code is hereby amended by the addition thereto of a new subsection (d) reading as follows: • ",(d) 'Special Services Officer' as used in this Chapter shall include 'License Inspector'." SECTION 5. Section 6214 of the West Covina Municipal Code is hereby amended to read as follows: 116214. FAILURE TO SECURE A LICENSE. PENALTIES. The penalty for the failure to secure a license as required by this Chapter shall be as follows: Whenever the fee required by this Chapter is not paid on or • before the date due or within thirty days thereafter, a penalty of ten percent of the amount due shall be imposed, and an additional penalty of ten percent of the original fee shall be added at the close of business of the last day of each calendar month there- after. Each penalty shall become part of the license fee required by this Chapter. However, in no case shall the total penalty exceed one hundred percent of the original fee. In the case of a newly established business at a fixed place for which a license is prescribed, no penalty shall be imposed if the fee shall be paid within fifteen days after the commencement of operation. Otherwise penalty shall be imposed as in.the case of any other business." SECTION 6. Section 6223 of the West Covina Municipal Code is hereby amended to read as follows: "6223. LICENSE EXEMPTIONS. VETERANS. Every peddler, solicitor, or other person claiming to be entitled to exemption from the payment of any license provided for in this Chapter upon the ground that he is an honorably discharged or released soldier, sailor or marine of the United States or Con- federate States who is physically unable to obtain a livelihood by . manual labor and who shall be a qualified elector of the State, as provided in the laws of this State, shall, in addition to any other information required by this Chapter also file with the License Collector a certificate of a regularly licensed and practicing physician dated within a month of said application, to the effect that said applicant is physically unable to obtain a livelihood by manual labor, and stating the nature of said incapacitation; pro- vided no license shall be issued to an honorably discharged or released soldier, sailor or marine of the United States or Con- federate States who is physically unable to obtain a livelihood by manual labor, and who shall be qualified for exemption from payment of the fee as herein provided, except where he or she shall be actively engaged in the management and conduct of the business for which said license shall be issued." SECTION 7. Section 6225 of the West Covina Municipal Code is hereby amended to read as follows: 116225. EXEMPTIONS LIMITED. No business shall be exempt from the payment of any license fee imposed hereunder except those specifically listed in this Chapter as exempt and those exempt by Federal or State law." SECTION 8. Section 6226 of the West Covina Municipal Code is hereby repealed, and Section 6226.1 is hereby renumbered as Section 6226. SECTION 9. The first paragraph of Section 6233 of the West • Covina Municipal Code is hereby amended to read as follows: "6233. PEDDLERS, SOLICITORS AND JUNK DEALERS. PERMIT REQUIRED. Before any person is granted any license as a peddler or solicitor of any kind, whether entitled to an exempt license or not, or as a junk dealer, he, and each of his agents or employees who -2- • will peddle or solicit within the City, shall first furnish to the City Clerk, or his.authorized assistant or deputy, a written and signed application for a peddler's or solicitor's permit accompanied by an application fee of $5.00 to cover costs of investigation. No person shall peddle or solicit within the City without having on his person a valid and effective peddler's or solicitor's permit issued by the City Clerk or License Clerk and an identification card issued by the Police Department." SECTION 10. Sections 6235.1 through 6235.6, inclusive, of the West Covina Municipal Code are hereby amended to read, respectively, as follows: 116235.1. CATEGORY CODE A. Apartments, Hotels, Motels, Convalescent Homes, Nursing Homes, Hospitals, and businesses of a like nature or similar character, whether any of which are benevolent or non-profit or not: Minimum of $40.00 per year for the first five units plus an additional $3.00 a year for each unit over five in number. 6235.2. CATEGORY CODE R. Retail Businesses listed below, and all other persons engaged in the business of making sales at retail where 75% of the total revenues of such business are derived from such sales, except as otherwise provided in this Chapter: Appliance Stores Auto Accessories • Bakeries Book Stores Candy Shops Carpet & Rug Stores Children's Wear Department Stores Drug Stores Florists Furniture Gift Shops Hardware Health Food Stores Ice Cream Stores Jewelry Stores Ladies Wear Liquor Stores Mattress Shops Men's Stores Music Stores Newspaper Offices New Car Dealers Pet Stores Pool Supply Stores Printers TV -Radio Stores Restaurants Taverns and Bars Service Stations Shoe Stores Shoe Repair Sporting Goods Toy Stores Variety Stores Wallpaper & Paint Yardage & Drapery Minimum of $40.00 a year (includes one owner, proprietor, manager or principal) plus: 5.00 for each of first 4.00 for each employee 3.00 for each employee five employees between 5 and 31 in number over 30 in number 6235.3. CATEGORY CODE M. Manufacturers, Wholesalers, Newspaper Publishing, Grocers, Meat Markets, Transfer and Storage Companies, and businesses of. a like nature or similar character: Minimum of $40.00 a ear (includes one owner, proprietor, manager or principal plus: • 4.00 for each of first 50 employees 3.00 for each employee between 50 and 501 in number 2.00 for each employee over 500 in number 6235.4. CATEGORY CODE P. CATEGORY CODE C. Contractors General Contractors - $100 per,;year Special Contractors, -,including all contractors other than General Contractors - $50.00 per year 6235.6. CATEGORY CODE S. Special Businesses - Fixed Fees Shall Be As Stated Below: 1. Finance Companies - $7s00.00/yr. 2. Savings and Loan Associations - $100.00/yr. 3. Dance Permit (a) Public, (b) Cabaret Dancing - $200.00/yr. $25.00/dance 4. Skating and Roller Rink - $100.00/yr. 5. Land Fills and Dumps - $500.00/yr. 6. Theatres and Movies - $.10/seat per year for first 500 seats plus 5� for each seat over 500 in number 7. Gyms and Figure Salons - $60.00/yr. 8. Billiard Parlors - $25.00 + $5.00 per table 9. Bowling Alleys - $25.00 - $5.00 per alley 10. Mailing and Telphone Service - $40.00 11. Washing Machines and Dryers - $2.00 each if coin operated 12. Vending Machines, each: 1� - $2.00/yr.; 5� - $4.00/yr.; 10� or more - $6.00/yr. prorated semi-annually 13. Peddlers and Solicitors - $10.00/day or $100.00/yr. 14. Junk Dealers - $10.00/day or $200.00/yr. 15. Bankruptcy, liquidation and like sales: 30-day sale - $25.00; 60-day sale - $50.00; 90-day sale - $75.00 (shall not apply to a licensed business conducted for at least one year immediately_ preceding such sale) 16. Carnivals and Circuses - $200.00 for first day + $100.00 succeeding days 17. Game or Amusement Machines - $20.00 each/yr. prorated quarterly 18. House Movers - $100.00/yr. or $25.00/day 19. Taxicab Operators - $20.00 per cab or $200.00/yr. per company 20. Retail Delivery Trucks (place of business not in City) - $20.00/yr. or $200.00/yr. per company 21. Wholesale Delivery Trucks (place of business not in City) - $15.00 yr. or $150.00/yr. per company 22. Vendors of Foods on Foot or by Vehicle - $40.00/yr. 23. Shoe Shine Stand - $10.00/yr. if not inside other business • 24. Laundromat -coin operated - $40.00/yr. + $1.00 for each machine over 30 in number 25. Utility Company Service Vehicles, except utilities which may fall into other categories - $20.00/yr. per vehicle to maximum of $500.00/yr. per company." SECTION 11. Sections 6235.7 through 6235.20, inclusive, of the West Covina Municipal Code are hereby repealed. SECTION 12. The West Covina Municipal Code,is hereby amended by the addition thereto of a new Section 6240 reading as follows: "6240. EXEMPTIONS FROM REGULATIONS. -' Section 6239 and all regulatory provisions of this Chapter shall not apply to those businesses which it is unlawful for a city to regulate because of Federal or State law." SECTION 13. This being an ordinance relating to taxes for the usual and current expenses, the same shall take effect immediately upon its passage. SECTION 14. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published as required by 1 aw .
