Repealed by Ordinance No. 1007 adopted September 11,1961 ORDINANCE NO. 1004 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING THE ANNEXATION TO, INCORPORATING IN AND MAKING A PART OF SAID CITY • OF WEST COVINA, CONTINGENT UPON ANNEXATION, CERTAIN UNINHABITED TERRITORY OUTSIDE THE SAID CITY AND CONTIGUOUS THERETO, KNOWN AS "SOUTHERLY ANNEXATION DISTRICT NO. 205". WHEREAS, under and pursuant to and in accordance with the provisions of the "Annexation of Uninhabited Territory Act of 1939", as amended, the City Council of the City of West Covina, in due course, on its own motion, initiated proceedings for the annexation to the said City of the uninhabited territory hereinafter described; and WHEREAS, the same was submitted to and reported upon favorably by the Boundary Commission of Los Angeles County with respect to the definiteness and certainty of the proposed boundaries of said territory, pursuant to Section 35002 of the Government Code of the State of Cali- fornia, and the said annexation has been approved by the Local Agency Formation Commission of said County subject to the completion of West Covina Southerly Annexation District No. 195; and WHEREAS, the City Council did on June 26, 1967, at a regular meeting thereof duly adopt a resolution initiating said proceedings and giving -notice of the proposed annexation, which resolution specifically described the boundaries of the territory so proposed to be annexed to the City of West Covina, and designated the same as • "Southerly Annexation District No. 205"; and WHEREAS, said resolution was duly published in accordance with law, which said resolution contained a notice of the day, hour and place when and where the City Council would hear protests made by any person owning real property within the territory proposed to be annexed, and said publications were complete twenty.days prior to the date of such hearing; and WHEREAS, the City Clerk did, not less than twenty days before the public hearing on the proposed annexation, cause a written notice, in accordance with the provisions of the Government Code, of said proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed on the last preceding equalized County Assessment Roll available on the date the proceedings were initiated, at the address shown on said assessment roll; and WHEREAS, the City Council of the City of West Covina set such hearing for a date not less than forty days nor more than sixty days from the date of the adoption of such resolution, to wit: for 8:00 o'clock P.M. on August 1 , 1967, before said City Council at the City Hall, West Covina; and WHEREAS, at the time set aforesaid, to wit: August 14, 1967, at 8:00 o'clock P.M. of said day, said matter duly came before said City Council at a regular meeting thereof for hearing, said hearing • was duly held, and a majority protest not having been presented against said proposed annexation in accordance with Section 35313 of the Government Code, and the Council having so found and declared by resolution adopted August 14, 1967; and C� WHEREAS, the property and territory hereinafter specifically described is contiguous to the corporate limits of the City of West Covina and is uninhabited within the meaning of Section 35303 of the said Government Code; NOW, THEREFORE, the City Council of the City of West Covina does ordain as follows: SECTION 1. That the annexation to the City of West Covina of the territory hereinafter described, and which territory was des- ignated in the resolution and notice of said City Council as "Southerly Annexation District No. 205", be and the same is hereby ordained to be annexed to, incorporated in, and made a part of the City of West Covina, effective upon the annexation thereof to the City of West Covina, to wit : That portion of the Rancho La Puente in the County of Los Angeles, State of California, as per map recorded in Book 10 pages 43 and 44 of Patents on file in the office of the County Recorder of said County described as follows: Beginning at the intersection of the easterly prolonga- tion of the centerline of Amar Road, 60 feet wide, as said centerline is shown on map of Tract No. !�1408 recorded in Book 558 pages 29 through 34 inclusive of Maps, in the office of the County Recorder of said County and the westerly boundary of the City of West Covina as same existed on September 27, 1963, with the filing of the affidavit of completion for "Southerly Annexation District No. 181' (Ordinance No. 815); thence westerly along said easterly prolongation and continuing westerly along said centerline of Amar Road a distance of 831.07 feet to the beginning of a tangent curve con- cave to the southwest and having a radius of 1500 feet, said 1500 foot radius curve being also the centerline of the new alignment of Amar Road, 100 feet wide, as shown on map of said tract; thence southeasterly along said 1500 foot radius curve to its intersection with the most southwesterly delineated centerline of Pass and Covina Road, 60 feet wide, as shown on map of said Tract No. 21408; thence northeasterly, radially from said 1500 foot radius curve, 30 feet to said westerly boundary of the City of West Covina; thence northwesterly along said westerly boundary of the City of West Covina to the point of beginning. Said territory shall be designated as "Southerly Annexation District No. 205". SECTION 2. Section 1 of this ordinance shall be effective when and only when West Covina "Southerly Annexation District No.195" has been completed and is effective. SECTION 3. The City Clerk shall certify to the adoption of this ordinance, and prior to the expiration of fifteen days from the • passage thereof, shall cause the same to be published once in the West Covina Tribune, a newspaper of general circulation published and circu- lated in the City of West Covina, and thirty days from and after the -2- final passage thereof shall file a certified copy thereof with the Secretary of State of the State of California; and after such certified copy has been so filed, and a certificate of the Secretary of State certifying to its filing has been received by the City of West Covina, and then, but only after Southerly Annexation District No. 195 has been completed and is effective, the City Clerk shall • do the following: file a copy of the map of said territory with the following: The County Surveyor of Los Angeles County, the County Recorder of Los Angeles County, the Board of Supervisors of the County of Los Angeles, the County Assessor of said County, the County Engineer of said County, the Board of Equalization of the State of California, and the Census Bureau of the United States Government and shall file the affidavit with said County Recorder as required by Section 34080 of the Government Code. • • Passed and approved this STATE OF CALIFORNIA COUNTY OF LOS ANGELES SS. That, thereafter, said ordinance was duly adopted and passed at a regular meeting of the City Council on the 28tk day of August , 1967, by the following vote, to wit: AYES: Councilmen: Gillum, Nichols, Gleckman, Snyder, Krieger.
