Ordinance - 975t ORDINANCE NO. 975 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA AMENDING SECTIONS 8113 THROUGH 8117 OF THE WEST COVINA MUNICIPAL CODE RELATING TO SIDEWALKS. The City Council of the City of West Covina does ordain as follows: SECTION 1. Sections 8113 through 8117 of the West Covina Municipal Code are hereby amended to read respectively as follows: 118113. REQUIREMENTS: FRONTAGE AND RIGHT OF WAY a) No store building or other structure to be used for any business or commercial purpose shall hereafter be erected unless the frontage of the lot, or parcel of land upon which such building or structure is erected, abuts on one side of a public street between two intersecting streets and unless the front of such building or structure shall abut on and face such public street, provided, however, that when practical difficulties or unnecessary hardships result through,the strict and literal interpretation and enforcement of the provisions hereof, the City Council may, upon the adoption of a precise plan for the development of a particular lot or parcel of land and upon such conditions as it • may establish, expressly vary or waive the requirements of this Section. b) A building permit shall not be issued for any structure on a street or right of way which is not a standard width street, or right of way as defined in Section 9102 of this Code, unless expressly authorized by the City Council. 118114. CONSTRUCTION OF CURBS, GUTTERS AND SIDEWALKS a) Any person constructing or arranging for the construction of a building, dwelling or other improvements costing $1,500.00 or more shall also provide for the construction of Portland, Cement concrete curbs, gutters and sidewalks in accordance with the standard specifications of the City, unless adequate standard Portland Cement concrete curbs, gutters and sidewalks already exist, along all street frontages adjoining the lot or lots on which the building, dwelling or improvement is to be constructed, except as provided in the following sections hereof. • b) Such curbs, gutters and sidewalks, where required, shall be completed before a certificate of comple- tion or certificate of occupancy is issued. 5M c) Portland Cement concrete sidewalks shall be installed in single family residential zones in any block (meaning one side of a street between intersecting streets) WHEN: • 1. The building, dwelling or improvement to the property exceed $ls500.00 in estimated costs as determined by the Building Depart- ment of the City, and 2. At least 50% of the block has sidewalks installed. 1181l5. LOCATION: CURBS, GUTTERS AND SIDEWALKS a) Curbs, gutters, and sidewalks shall be placed along all streets in the City with the following additional exceptions: 1. Land zoned for single family residential use in area District V. unless fronting or siding a street shown on the "Select System of City Streets." 2. Where topographic conditions would make the construction of curbs, gutters or sidewalks impractical. b) Placement of sidewalks shall be located one-half foot (0.5 9 from property lines, unless otherwise • specified by either Planning Commission or City Council. 118116. REQUIREMENTS: CURBS, GUTTERS AND SIDEWALKS a) Definitions: 1. Back-up lots as used in this section shall mean oTs wFich are bounded by two or more public streets and are walled or fenced off from the parkway area of said street or streets. 2. Full width sidewalk as used in this section shall mean a s ewalk whose width measures from property line to curb -line. b) Where full -width sidewalks are not required those parts of the parkway areas not covered with Portland Cement concrete sidewalk shall be land- scaped with trees and other plant materials to meet City standards. c) Sidewalk widths shall be as follows: 1. Single Family Residential: a. A minimum sidewalk width of b. Full width sidewalks on all to the rear or side lot line lots. -2- four feet (41 ) streets adjacent of back-up 2. Multiple Family Residential a. A minimum sidewalk width of five feet (5') b. Full width sidewalks on all streets • adjacent to the rear or side lot line of back-up lots. 3. Offices, Commercial, and Manufacturing a. Full width sidewalks required unless expressly waived by Planning Commission or City Council. 4. Industrial Park, Public Buildings and Devel- opments requiring an Unclassified Use Permit. a. Sidewalk width shall be determined by Precise Plan. d) Landscaping provisions for full width sidewalks 1. Not less than one (1) tree well, minimum dimensions 3.16" x 316" shall be provided on all full width sidewalks for each forty (40) linear feet thereof. The Director of Recrea- tion and Parks may permit a greater distance between tree wells when in his opinion, the existence of poles, signs hydrants, meters, ✓ curb breaks, or specie of tree in any given area require greater spacing. • 2. Other improvements to be included as part of the parkway landscaping shall be: a. A permanent water irrigation system to tree wells. 1. In single family residential areas such water irrigation system shall be metered to the City for maintenance. b. Standard tree well improvements as required by the City. 118117. MODIFICATION OF REQUIREMENTS: CURBS, GUTTERS AND SIDEWALKS The provisions of Section 8114 may be modified or waived by the City Engineer under the following circumstances and to the following extent, and under such reasonable conditions as he may impose: a) TOPOGRAPHY. Portland Cement.concrete curbs and gutters only shall be required where the topog- raphy is such that the installation of Portland • Cement concrete sidewalks would be impractical in the opinion of the City Engineer. -3- b) STREET GRADE. Portland Cement concrete curbs, gutters or sidewalks need not be installed where the final street grade cannot readily be estab- lished by the City Engineer. c) IMPRACTICAL GRADING. Where the street for practical reasons has not been or cannot be readily graded to the established grade which would enable proper location of curb and sidewalks. d) HAZARDS. Where installation of Portland Cement concrete sidewalks would be hazardous to pedestrians because of the grade." SECTION 2. The City Clerk shall certify to the passage of this ordinance and cause the same to be published as required by law. Approved and passed this STATE OF CALIFORNIA COUNTY OF LOS ANGELES SS.
