Ordinance - 943ORDINANCE NO. 943 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA AMENDING CERTAIN PROVISIONS OF THE WEST COVINA MUNICIPAL CODE RELATING TO CURBS, GUTTERS AND SIDEWALKS. The City Council of the City of West Covina does ordain as follows: SECTION 1. The City Council does hereby find, determine and declare that the following amendments were duly initiated, that notice of hearing thereon was duly given and published, that public hearings thereon were duly held by the Planning Commission and City Council, and that the public convenience and necessity and the general welfare require that the following amendments be made. SECTION 2. Section 8115 of the West Covina Municipal Code is hereby amended to read as follows: 118115. LOCATION. CURBS, GUTTERS AND SIDEWALKS. A. Curbs, gutters, and sidewalks shall be placed along all streets in the City with the following exceptions: 1. Land zoned for single family residential use in Area Districts IV and V, unless fronting or siding a street shown on the. 'Select System of City Streets'. 2. Where topographic conditions would make the construction of curbs, gutters or sidewalks impractical. B. Parkway widths shall be no less than ten feet on all streets in accordance to.adopted City standards. Placement of sidewalks shall be located one-half foot (0.51) from property lines, unless other- wise specified by either Planning Commission or City Council. C. In no case shall a Building Permit be issued for any structure on a street or right-of-way which is not a standard width street, or right-of-way as defined in Section 9102 of this Code, unless expressly authorized by the City Council." SECTION 3. Section 8117 of the West Covina Municipal Code is hereby amended to read as follows: 118117. SIDEWALK, CURB AND GUTTERS. EXCEPTIONS. REQUIREMENTS. A. Where parcels in residential zones are divided into one acre or larger lots, the Portland Cement concrete curb and gutters, or Portland Cement concrete curbs, gutters and sidewalks need not extend a greater distance than the sideyards or side and rear yards in the case of corner lots as defined in Article IX, Chapter 2 of this Code and measured from the principal structure or structures' on the parcel or lot. B. Portland Cement concrete sidewalks need not be installed in single family residential zones in any block (meaning one side of a street between intersecting streets) where fifty percent or more • of the frontage is in lots or parcels which have been improved with a permanent dwelling but not with sidewalks. C. Sidewalk widths shall be as follows: 1. A minimum of five foot (51) width sidewalks in all locations with the exception of land zoned for single family residence wherein a minimum sidewalk width of four foot (41) will be permitted. 0 2. Full width sidewalks to be optional in all locations with the exception of land zoned for single family residences, if provisions for street trees are met. 3. Full width sidewalks to be required on all streets where back-up or side -on lots occur. Street trees (landscaping) to be required in conformance with City standards. D. Minimum four feet by four feet tree wells shall be provided in all full width sidewalks.' Other improvements to be included as part of the parkway landscaping are: 1. A permanent water irrigation system, metered to the City for maintenance. 2. Grates, tree protections and the drains as approved by the Recreation and Park Department." SECTION 4. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published as required by law. Passed and approved this 18th day of October , 1965.
