AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA AMENDING CERTAIN SECTIONS OF THE
WEST COVINA MUNICIPAL CODE RELATING TO PRECISE
PLANS AND SLIGHT MODIFICATIONS.
• The City Council of the City of West Covina does ordain as
follows;
SECTION 1. The City Council does hereby find, determine
and declare that the following amendments were duly initiated, that
notice,of hearing thereon was duly given and published, that public
hearings thereon were duly held by the Planning Commission and City
Council, and that the public convenience and necessity and the general
welfare require that the following amendments be made.
SECTION 2. Subsection (a) of Section 9218.3 and Section
9218.4 of .the West Covina Municipal Code are hereby amended to read,
respectively, as follows:
v(a) In the approval or rejection of a precise plan of design,
consideration shall be given and restrictions shall be imposed to
the extent necessary, in view of the size and shape of the parcel
and the present and proposed zoning and use of the subject property
and the surrounding property, to permit the same degree of enjoy-
ment of the subject property, but subject to the same degree of
protection of adjoining properties, as would be accorded in
normal circumstances by the standard restrictions imposed by this
Chapter. The standard restrictions imposed in the various zones
by this Chapter relating to the subjects mentioned in Section
• 9218.1 are intended as minimum restrictions necessary in normal
circumstances to prevent substantial depreciation of property
values in the vicinity, unreasonable interference with the use
and enjoyment of property in the vicinity by the occupants thereof
for lawful purposes and the protection of the public peace, health,
safety and general welfare. 'Normal circumstances' are intended
to refer to the case of a permitted use upon a lot of a normal
size and shape surrounded by property in the same zone as the lot
in question.
9218.14. SAME. PROCEDURE.
Application for approval of a precise plan of design or an
amendment thereof shall be made in such form as the Planning Com-
mission shall prescribe. The procedure (but not the grounds) set
forth in Part 22 of this Chapter shall apply to the processing and
approval or rejection of proposed precise plans of design and
amendments thereof. If the application for approval of a precise
plan of design or amendment is not filed concurrently with an
application for a change of zone, for an unclassified use permit,
or for a variance (other than a slight modification) and does not
relate to territory within the Civic Center Area, the application
shall be processed through the Review Board under the procedure set
forth in Section 9222.15 and the provisions of that section relating
to notice, hearing, appeal and filing fees shall prevail,. In all
other cases, the procedural provisions of Part 22, exclusive of
• Section 9222.15, shall prevail."
SECTION 3. The CityClerk shall certify to the y passage of this
ordinance and shall publish the same as required by law.
