Ordinance - 788ORDINANCE NO 788 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA AMENDING SECTIONS 9218.3 AND 9218.4 OF THE WEST �COVINA MUNICIPAL CODE RELATING TO THE REJECTION OR APPROVAL OF PRECISE PLANS OF DESIGN E THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. The City Council does hereby find, determine and declare that the following amendments were duly initiated, that notice of hearing thereon was duly given and published, that public i hearings thereon were duly held by the Planning Commission and City Council, and that the public convenience and necessity and the I general welfare require that the following changes and amendments be made. SECTION 2. Section 9218.3 of the West Covina Municipal Code is hereby amended to read as follows: ""9218.3. SAME. REJECTION OR APPROVAL, (a) In the approval or rejection of a precise plan of design, consideration shall be given and restrictions shall be imposed to the extent necessary, in view of the size and shape of the parcel and the present and proposed zoning and use of the subject property and the surrounding property, to permit the same degree of enjoyment of the subject property, but subject to the same degree of protec- tion of adjoining properties, as would be accorded in normal circumstances by the standard restrictions imposed by this Chapter. The standard restrictions imposed in the various zones by this Chapter relating to the subjects mentioned in Section 9218.1 are intended as minimum restrictions neces- sary in normal circumstances to prevent substantial depre- ciation of property values in the vicinity, unreasonable interference with the use and enjoyment of property in the vicinity by the occupants thereof for lawful purposes and the protection of the public peace, health, safety and general welfare. 'Normal circumstances' are intended to refer to the case of a permitted use upon a lot of a normal size and shape surrounded by property in the same zone as the lot in question. (b) If the proposed precise plan of design would sub- stantially depreciate property values in the vicnity or would unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes or would endanger the public peace, health, safety or general welfare, such plan shall be rejected or shall be so modified or conditioned before adoption as to remove said objections. ( (c) In addition to the foregoing grounds of rejection, if the property covered by said precise plan lies within the Civic Center Area, the Planning Commission and City Council, as the case may be, may also consider and take into account the exterior architectural design, general exterior -appear- ances, landscape, color, texture of surface materials and exterior construction, shape and bulk and other physical characteristics including location and type of public utility facilities, and if it is found that the proposed precise plan of design, including the considerations herein '. enumerated would interfere with the orderly development in the vicinity of said Civic Center Area, or with the existing or proposed public use thereof, such precise plan of design shall be rejected or shall be so modified or conditioned before adoption as to remove the said objections."' SECTION 3. Section 9218.4 of the West Covina Municipal Code is hereby amended to read as follows: *9218.4. SAME. PROCEDURE. Application for approval of a precise plan of design or an amendment thereof shall be made in such form as the Planning Commission shall prescribe. The procedure (but not the grounds) set forth in Part 22 of this Chapter shall apply to the processing and approval or rejection of proposed precise plan of design and amendments thereof." SECTION 4.
