Ordinance - 7839 ORDINANCE NO. 783 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA AMENDING THE WEST COVINA MUNICIPAL CODE SO AS TO REZONE CERTAIN PREMISES. (Zone Change No. 244 - Diedrich) The City Council of the City of West Covina does ordain as follows: SECTION 1. The City declare that the following zone c that notice of hearing thereon wa hearings thereon were duly held b City Council, and that the public welfare and good zoning practice and amendments be made. Council does hereby find, determine and hanges and amendments were duly initiated, s duly given and published, that public y the Planning Commission and by the convenience, necessity and general require that the following zone changes SECTION 2. The West Covina Municipal Code is hereby amended by the addition thereto of a new section 9202.2www reading as follows: "9202.2www. Zone Changes. Notwithstanding the provisions of Section 9202.2 and the Zoning Map referred to therein, the following described premises are hereby placed and included in the R-3 Multiple Family Residential Zone, to -wit: Those portions of Lots 1 and 2 of Eugene Riggins Sub- division of the Hathaway Tract, in the City of West Covina, County of Los Angeles, State of California, as shown on map recorded in Book 53,Page 37 of Miscellaneous Records, and Arroyo Avenue, now vacated, and portion of Lot 113 of E. J. Baldwin's Fourth Subdivision, recorded in Book 8, Page 186 of Maps, on file in the office of the County Recorder of said County, described as follows: Bounded on the South by the Northerly line of Garvey Avenue as recorded in the deeds to the State of Cali- fornia recorded in 1954; on the West by the Easterly line of Cameron Avenue; and on the Northeast by the Southwesterly line of Pacific Avenue, 60 feet wide. EXCEPTING therefrom that portion described as follows: Beginning at a point in the Southwesterly line of Pacific Avenue (60 feet wide) as described in final decree of condemnation filed as Document No. 190540 in the office of the Registrar of Titles of'said County, said point bearing North 460 05, 48" West along said Southwesterly line and 207.50 feet distant from the most Northerly corner of the land described in Parcel 3 in the deed to the State of California, registered May 18, 1954 as Document No. 7764-W and recorded in Book 44604 Page 341, Official Records of said County; thence South �460 05, 48" East 207.50 feet to said most Northerly corner; thence South 430 54, 12" West 10.00 feet; thence along the Westerly and Northwesterly lines of said Parcel 3, South 4° 381 26" East, 22.48 feet and South 360 49, 07" West, 100.86 feet to the beginning of a non -tangent curve having a radius of 708 feet, a radial line to said beginning of curvature bearing North 440 57' 30" West; thence Southwesterly along said curve through a central angle of 10 081 03" an arc distance of 14.22 feet, thence Northwesterly in a direct line to a point that bears North 720 55' 3011 East and distant 55 feet from the Northwesterly line of said Parcel 3; thence South 720 55' 30" West 45 feet; thence North 170 00 30" West, 170.99 feet; thence North 720 55' 30" East 30.25 feet; thence -1- Northeasterly to a point in the Southwesterly line of Pacific Avenue (60 feet wide) thence South 460 05, 4811 East 207.50 feet to the point of beginning. ALSO EXCEPTING therefrom: Beginning at the Northwesterly corner of said Lot 2; thence along the Southwesterly line of Pacific Avenue, 60 feet wide, as described in decree of condemnation entered in Case No. 269877 of the Superior Court in and for said County, a certified copy of said decree being recorded on July 7, 1930 as Instrument No. 1174 in Book 10043, Page 297 of Official Records of said County, South 450 171 46" East 225.80 feet; thence South �440 421 14" West 270.7 feet, more or less, to the Westerly line of said Lot 2; thence North 40 521 05" East along said Westerly line to the point of beginning." SECTION 3. The West Covina Municipal Code is hereby amended by the addition thereto of a new section 9202.2xxx reading as follows: 119202.2xxx. Zone Changes. Notwithstanding the provisions of Section 9202.2 and the Zoning Map referred to therein, the following described premises are hereby placed and included in the R-P Residential Professional Zone, to -wit: That portion of Lot 2 of Eugene Riggins Subdivision of the Hathaway Tract, in the City of West Covina, County of Los Angeles, State of California, Book 53, Page 37 of Miscel- laneous Records, in the office of the County Recorder, described as follows: • Beginning at the Northwesterly corner of said Lot 2; thence along the Southwesterly line of Pacific Avenue, 60 feet wide, as described in decree of condemnation entered in Case No. 269877 of the Superior Court in and for said County, a certified copy of said decree being recorded on July 7, 1930 as Instrument No. 1174 in Book 1004�, Page 297 of Official Records of said County, South 45 17t 46" East 225.80 feet; thence South 440 421 14" West 270.7 feet, more or less, to the Westerly line of said Lot 2; thence North 40 521 05" East along said Westerly line to the point of beginning."
