ORDINANCE NO. 733
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA AMENDING CERTAIN PROVISIONS OF THE
WEST COVINA MUNICIPAL CODE RELATING TO THE
INSTALLATION OF DOMESTIC WATER AND FIRE
PROTECTION FACILITIES.
The City Council of the City of West Covina does ordain as
follows:
SECTION 1. Section 8112 of the West Covina Municipal Code
is hereby amended to read as follows:
"8112... BUILDING WATER SUPPLY. FIRE PROTECTION.
New buildings and structures hereafter erected in the City,
and buildings and structures moved into or within the City, shall
conform to all of the requirements of the Building Code of the
City, and no permit shall be issued for the erection, construction,
enlargement, alteration, repair, moving or conversion of any such
building upon property within the City unless there be, or be made,
available a water system including conduits, pipes, hydrants, or
other appurtenances for supplying and distributing a domestic
water supply with mains and fire hydrants suitably located and
of sufficient size to furnish and provide adequate fire protection
to such property and to meet local neighborhood needs."
SECTION 2. Section 8112.1 of the West Covina Municipal Code
is hereby amended to read as follows:
"8112.1. SAME. OWNERIS RESPONSIBILITY.
• Where the facilities required by Section 8112 do not exist,
the Building Inspector may issue the permit referred to in Section
8112 hereof, provided the applicant for such permit shall first
enter into an agreement with the City to furnish adequate distri-
bution lines for domestic water supply and to provide adequate fire
protection facilities for his property and shall furnish either a
surety bond or cash bond guaranteeing the installation of the
necessary conduits, pipes, hydrants and other appurtenances
required. The amount of such bond shall be determined by the City
Engineer.
Where the facilities required by Section 8112 already exist
but the lot or parcel upon which the building or structure is to
be erected or moved has not been taxed or assessed for and has not
paid its just share of the cost of said facilities, the owner or
applicant for a permit shall pay to the City the just share of the
cost of such facilities attributable to such lot or parcel under
any reimbursement agreement or contribution or payment by the City
for such facilities.
Where a person is required to install facilities which will
also benefit property other than his own, the City may agree to
reimburse such person as, if and when and to the extent that it
receives payment hereunder from the owner of or applicant for a
permit on the other property so benefited, and may make such
reimbursement in accordance with such agreement."
SECTION 3. The City Clerk shall certify to the passage of
this ordinance and shall publish the same as required by law.
