AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA ADOPTING BY REFERENCE A FIRE PREVENTION
CODE AND AMENDING CERTAIN PROVISIONS OF THE WEST
COVINA MUNICIPAL CODE RELATING THERETO.
The City Council of the City of West Covina does ordain as
• follows:
SECTION 1. Section 3200 of the West Covina Municipal Code
is hereby amended to read as follows:
"3200. ADOPTION OF FIRE PREVENTION CODE.
There is hereby adopted by reference, for the purpose of
prescribing regulations governing conditions hazardous to life
and property from fire or explosion, that certain code known as
the Fire Prevention Code recommended by the National Board of
Fire Underwriters, being particularly the 1960 edition thereof
and the whole thereof, save and except such portions as are
hereinafter in this Chapter deleted, modified or amended, of
which code not less than three copies have been and now are
filed in the office of the City Clerk, and the same are hereby
adopted and incorporated as fully as if set out at length herein."
SECTION 2. Section 3201 of the West Covina Municipal Code
is hereby amended to read as follows:
"3201. DEFINITIONS.
The words used in the said code hereby adopted by reference
shall have the meaning ascribed to them within said code,.and in
addition thereto the following words shall be understood and
defined to have the following meanings:
(a) Whenever the term tAgency, is used, it shall mean
the City or the appropriate agency of said City as the context
may reasonable require.
(b) Whenever the term (Municipality► is used, it shall
refer to the City.
(c) Whenever the term 'Legislative Body, is used, it shall
mean the City Council of the City.
(d) Whenever the term 'enforcing officer' or 'chief enforc-
ing officer, or 'chief► is used, the said term shall refer to
the Chief of the City Fire Department, unless the City Council
or City Manager shall designate some other officer in place and
stead thereof.
(e) Whenever the term tChief of the Bureau of Fire Pre-
vention, is used, it shall mean Chief of the Fire Department of
the City, unless the City Council or City Manager shall desig-
nate some other officer in place and stead thereof.
(f) If any term used in said code shall refer to an
• officer, agency, board or body not set up by or within the City,
the said term shall be deemed to refer to such officer, body or
agency as shall in fact be charged with the responsibility of
performing the duty intended to be performed by -said officer,
agency, board or body."

SECTION 3. Section 3202 of the West Covina Municipal Code
is hereby amended to read as follows:
"3202. DELETIONS. FIREWORKS.
The Fire Prevention Code is amended and changed in the
following respects: Sections 13.1 to 13.6, inclusive, relating
to fireworks, are deleted."
• SECTION 4. Subsections (b), (c ), (e ), (f ), (g), and (h)
of Section 3203 of the West Covina Municipal Code are hereby amended to
read, respectively, as follows:
"(b) Paragraph 10, of Section 16.12 of Article 16 is hereby
deleted.
(c) Section 16.65 of Article 16 is hereby deleted.
(e) All of Appendix 'At and Appendix ID, are hereby deleted.
(f) All of Article 9 is hereby deleted.
(g) Appendix IBI is hereby amended to mean and include any
amendments or revisions of the titles or dates of the
aforesaid secondary codes to date.
(h) Paragraphs (a) and (b) of Section 28.1 of Article 28
are hereby amended to read as follows:
Section 28.1 BONFIRES AND OUTDOOR RUBBISH FIRES
(a) Subject to Air Pollution -Control District. All
burning or combustible elel waste material permitted
under this Section is subject to the restrictions
of the Air Pollution Control District, County of
Los Angeles, as the same now exists, or are here-
after amended.
(b) Fires on Public Property. It shall be unlawful
or any person except an officer or employee of
the City within the scope of his duties, to set
fire to, ignite, or burn any combustible material
or substance upon any street, alley, sidewalk,
park, parkway or other public property within the
city.
Exceptions. This provision shall not prohibit a
person from utilizing cooking and campfire
facilities provided in City Parks if required
permits are first obtained."
SECTION 5. The first sentence of subsection (d) of Section
3203 of the West Covina Municipal Code is hereby amended to read as
follows:
"(d) Article 16 is hereby amended by addition of a new
section to be known as Section 16.70, to follow
immediately after Section 16.69 of said Article, and
• which shall read as follows:"
and the number of Section 15.508, quoted therein, is hereby changed to
16.70.
SECTION 6. Section 3203 of the West Covina Municipal Code
is hereby amended by the addition thereto of a new subsection (i) read-
ing as follows:

"(i) Article 28 is amended by_.the addition thereto of the
following new sections:
Section 28.13 AUTHORITY TO CORRECT DEFECTIVE CONDITIONS
(a) No person shall maintain or use or cause to be
maintained or used, any device, appliance,
apparatus, equipment, tank, tank vehicle, busi-
ness, process, structure, or other place or thing
which does not conform to the provisions of this
Code, or which is not specifically covered under
the provisions of this Code, which due to improper
use, maintenance, or to a defective condition,
constitutes, or contributes to, or creates a
condition liable to cause fire.
(b) when any such condition is found it shall be the
duty of the Chief to order in writing an abate-
ment or correction thereof, or the installation
of adequate safeguards, which shall conform to
the minimum requirements of any ordinance of the
City, State law, or order as promulgated by the
Fire Marshal of the State.
In the event there is no such ordinance, law or
order covering the specific condition, then any
such written order given by the Chief shall be
based upon the minimum requirements in the current
recommendations of the National Board of Fire
Underwriters, or other Nationally recognized
authority.
(c) Unless immediate action is taken to comply with
his order, --then the Chief shall have the power to
cause any act, performance, activity, operation
or other condition contributing to, or creating
such condition to cease until proper correction
or compliance is made.
Section 28.14 DUMPING ON VACANT LOTS
It shall be unlawful for any person to deposit any grass,
weeds, brush, debris, trash or other waste material upon
any vacant lot or parcel of ground within the City, except
with the written consent of the owner thereof.
Section 28.15 VACANT BUILDINGS
Every person owning or in charge or control of any vacant
building shall remove therefrom all accumulations of
flammable or combustible waste and rubbish and shall
securely lock, barricade or otherwise secure, all windows,
doors and other opening thereof, so as to prevent unauth-
orized persons from gaining access thereto.
Section 28.16 BLOCKING FUSES
It shall be unlawful for any person to block or allow to
• be blocked in any manner any fuse or fuses used in any
electrical circuit located within any building or structure."
SECTION 7. Section 3204 of the west Covina Municipal Code
is hereby amended to read as follows:
"3204. ESTABLISHMENT OF LIMITS OF DISTRICTS IN WHICH
STORAGE OF FLAMMABLE LIQUIDS IN OUTSIDE ABOVE-
GROUND TANKS IS TO BE PROHIBITED.

(a) The limits referred to in Section 16.22 of the Fire
Prevention Code in which storage of flammable liquids in outside
aboveground tanks is prohibited, are hereby established as fol-
lows: any area of the City except that specifically designated
under the provisions of the Zoning Ordinance of the City as
Zone M-1.
• (b) The limits referred to in Section 16.51 of the Fire
Prevention Code, in which new bulk plants for flammable liquids
are prohibited, are hereby established as follows: any area of
the City except that specifically designated under the provisions
of the Zoning Ordinance of the City as Zone M-1."
SECTION 8. Section 3205 of the West Covina Municipal Code
is hereby amended to read as follows:

"3205. ESTABLISHMENT OF LIMITS IN WHICH BULK STORAGE OF
LIQUEFIED PETROLEUM GASES IS TO BE RESTRICTED.
The limits referred to in Section 21:6a of the Fire Pre-
vention Code, in which bulk storage of liquefied petroleum gas
is restricted, are hereby established as follows: the entire
area of the City."
SECTION 9. The City Clerk shall certify to the passage of
this ordinance and shall publish the same as required by law.

meeting of the City Council on the 22nd day of May 196l, by
