Ordinance - 700ORDINANCE NO. 700 AN ORDINANCE OF THE CITY OF WEST COVINA, CALIFORNIA, ORDERING, CALLING, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL ELECTION TO BE HELD IN THE CITY OF WEST COVINA ON THE 6TH DAY OF JUNE, 1961, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY A PROPOSITION TO INCUR BONDED INDEBTEDNESS BY SAID CITY FOR A CERTAIN MUNICIPAL IMPROVEMENT. WHEREAS, the City Council of the City of West Covina, Cali- fornia, did on the loth day of April, 1961, by a vote of more than two- thirds of the members of said City Council, adopt Resolution No. 2079 , entitled "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVIIM, CALIFORNIA, DETERMINING THAT THE PUBLIC.INTEREST AND NECESSITY DEMAND THE ACQUISITION AND CONSTRUCTION OF A CERTAIN MUNICIPAL IMPROVEMENT, AND MAKING FINDINGS RELATING THERETO," which said resolution was duly signed and approved by the Mayor of said city.and attested and certified by the City Clerk of said city; NOW, THEREFORE, the City Council of the City of West Covina DOES ORDAIN as follows: SECTION 1. That a special election be held, and the same is hereby called to be held, in the City of West Covina, California, on the 6th day of June, 1961, for the purpose of submitting to the qualified voters of said city the proposition hereinafter set forth of incurring indebtedness and issuing bonds of said /city therefor, in the amount hereinafter set forth, and for the object and purpose set forth in said resolution and in the ballot proposition hereinafter set forth. SECTION 2. That the estimated cost of said municipal improvement is the sum of $800,000 and that the amount of the principal - of the indebtedness to be incurred therefor is the sum of $800,000. The estimated cost of said municipal improvement includes any or all of the following: (a) legal and other fees incidental to or connected with the authorization, issuance and sale of the bonds, and (b) the costs of printing the bonds and other costs and expenses incidental to or connected with the issuance and sale of the bonds. SECTION 3. That the maximum rate of interest to be paid on said indebtedness shall not exceed the maximum rate permitted by law, to -wit, six per cent (6%) per annum, payable annually the first year and semi-annually thereafter, the actual rate or rates of interest on said bonds to be determined at or prior to the time of the sale or sales thereof. SECTION 4. That if the proposition for the incurring of bonded indebtedness so submitted receives the requisite number of votes, to -wit: two-thirds of the votes of the qualified electors voting on said proposition, bonds of said city, in not exceeding the principal amount stated in such proposition, shall be issued and sold for the object and purpose set forth in said proposition. SECTION 5. That the polls for said election shall be opened at seven o'clock A.M., of the day of said election and shall remain open continuously from said time until seven o1clock P.M., of athe same day, when said polls shall be closed, except as provided in Section 5734 of the Elections Code of the State of California. SECTION 6. That on the ballots to be used at said special election, in addition to any other matters required by law, there shall be printed substantially the following: -1- MARK CROSS (+) ON BALLOT ONLY WITH RUBBER STAMP NEVER WITH PEN OR PENCIL. (ABSENTEE BALLOTS MAY BE MARKED WITH PEN D K OR PENCIL. INSTRUCTIONS TO VOTERS To vote on any measure, stamp a cross W in the voting square after the word "YES' or after' the word "NO". All marks, except the cross (+) are forbidden. All dis- tinguishing marks or erasures are forbidden and make the .ballot void. If you wrongly stamp, tear or deface this ballot, return it to the inspector of election and obtain another. On absent voter ballots mark a cross (+) with pen or .pencil. • CITY OF WEST COVINA PARK AND RECREATION BONDS: : Shall the City of West Covina incur a bonded indebtedness in the principal sum of $800,000 for the acquisi- tion and construction by said city of a certain municipal YES : improvement, to -wit: additions to and development of the facilities of the city for : community recreation, includ- ing the development of parks by the landscaping and plant- ing of grounds and the con- struction of playing grounds, fields and courts, swimming pools and bathhouse facilities, picnic facilities, restrooms, recreation buildings, outdoor : amphitheaters, water facilities, - : lighting facilities, sanitary NO : sewers, drainage facilities, : walks, curbs and vehicle : parking areas, and including : for any of the foregoing the : acquisition of all land, works, z - : equipment, apparatus and : other property necessary therefor? - SECTION 7. A cross (+) placed in the voting square after •the word "YES" in the manner hereinbefore provided shall be counted in favor of the adoption of the question or proposition. A cross (+) placed in.the voting square after the word "NO" in the manner herein - before provided shall be counted against the adoption of the question or proposition. -2- SECTION 8. That for the purpose of holding said special election there shall be and are hereby established twenty-seven (27) voting precincts designated as hereinafter stated. Each such voting precinct shall consist of a consolidation of regular election precincts in the city of West Covina (of the numbers hereinafter stated) estab- lished for the holding of state and county elections, as said regular election precincts exist on the date of adoption of this ordinance. hat the polling places for the respective precincts shall be the places ereinafter designated; and that the persons hereinafter named, being competent and qualified electors and residents of said city and of their respective voting precincts, are hereby appointed officers of election for their respective voting precincts and they shall hold said election and make return thereof in the manner provided by law. That the City Council of said city shall meet at its usual place of meeting in the City Hall on Tuesday, the 13th day of June, 1961, at 7:30 o'clock P.M., of said day, and proceed to canvass the selection returns and declare the result of said election. SECTION 11. That the City Clerk shall certify to the passage and adoption of this ordinance by a vote of more than two-thirds of all of the members of the City Council of said city, and shall cause this ordinance to be published once a week for two (2) weeks in the WEST COVINA TRIBUNE, a newspaper of general circulation, printed and published less than six (6) days a week in said city. No other notice of such election need be given. SECTION 12. This ordinance shall take effect upon its adoption. ADOPTED, SIGNED AND APPROVED this 24th day of April, 1961.
