ORDINANCE NO. 628
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA, CALIFORNIA, APPROVING THE ANNEXATION
TO, INCORPORATING IN AND MAKING A PART OF SAID CITY
OF WEST COVINA, CERTAIN UNINHABITED TERRITORY OUTSIDE
THE SAID CITY AND CONTIGUOUS THERETO, KNOWN AS "WEST
COVINA NORTHEASTERLY ANNEXATION DISTRICT NO. 164%
WHEREAS, under and pursuant to and in accordance with the
provisions of the "Uninhabited Territory Act of 1939", as amended, the
City Council of the City of West Covina, -in due course, on its own
motion, initiated proceedings for the annexation to the said City of
the uninhabited territory hereinafter described; and
WHEREAS, prior to the initiation by the City Council of
said City of the proceedings for the annexation of said territory to
the City of West Covina, the same was submitted to and reported upon
favorably by the Boundary Commission of Los Angeles County with respect
to the definiteness and certainty of the proposed boundaries of said
territory,,. pursuant to Section 35002 of the Government Code of the State
of California; and
WHEREAS, the City Council did at a regular meeting thereof
duly adopt a resolution initiating said proceedings and giving notice
of the proposed annexation, which resolution specifically described the
boundaries of the territory so proposed to be annexed to the City of
West Covina, and designated the same as "West Covina Northeasterly
Annexation District No. 16411; and
WHEREAS, said resolution was duly published in accordance
with law, which said resolution contained a notice of the day, hour
and place when and where the City Council would hear protests made
by any person owning real property within the territory proposed to.
be annexed, and said publications were complete twenty days prior to
the date of such hearing; and
WHEREAS, the City Clerk, did, not less than twenty days before
the public hearing on the proposed annexation, cause a written notice,
in accordance with the provisions of the Government Code, of said pro-
posed annexation to be mailed to each person to whom land within the
territory proposed to be annexed is assessed on the last preceding
equalized County Assessment Roll available on the date the proceedings
were initiated, at the address shown on said assessment roll; and
WHEREAS, the City Council of the City of West Covina set
such hearing for a date not less than forty days nor more than sixty
days from the date of the adoption of such resolution, to -wit: for
8:00 ot,.clock. P.M. on May 11, 1959, before said City Council at the
City Hall, West Covina; and
WHEREAS, at the time set aforesaid, to -wit: May 11, 1959,
at 8:00 of„clock P.M. of said day, said matter duly came before said
City Council at a regular meeting thereof for hearing, and a majority
protest not having been presented against said proposed annexation in
accordance with Section 35313 of the Government Code, and
WHEREAS, the property and territory hereinafter specifically
described is contiguous to the corporate limits of the City of West
Covina and is uninhabited within the meaning of Section 35303 of said
Government Code;
NOW, THEREFORE, the City Council of the City of West Covina
does ordain as follows:

SECTION 1. That the annexation to the City of West Covina
of the territory hereinafter described, the boundary description of
which was submitted to and duly approved by the Boundary Commission of
Los Angeles County as to definiteness and certainty, and which territory
was designated in the resolution and notice of said City Council as
"West Covina Northeasterly Annexation District No. 164", be and the same
is hereby approved, and that the following described territory be, and
the same is hereby ordained to be annexed to, incorporated in, and
made a part of the City of West Covina, to -wit:
All that property in the County of Los Angeles, State
of California, lying within the following described
boundaries:
That portion of Lot 1 of Block 25 of Phillips Tract in
the County of Los Angeles, State of California, as per
map recorded in Book 9, pages 3 and 4 of Miscellaneous
Records in the office of the County Recorder of said
County -described as follows:
Beginning at the intersection of the southerly line of
said Lot 1 with a line parallel with and 48 feet south-
easterly, measured at right angles, from that centerline
of "Los Angeles County Flood Control Right of Way" for
Walnut Creek. Wash, 50 feet wide, as said "Right of Way"
is shown on County Surveyor '1s Map No. B-430, sheet 1,
on file in the office of the Engineer of said County;
thence along said parallel line N 330 53!; 10" E. 108.23
feet to the beginning of a nontangent curve,�concave to
the southeast and having a radius of 1760 feet, a radial
line from the beginning of said curve bears S 500 38' 55" E;
thence northeasterly along said curve 210.00 feet to a
point from which a radial line bears S 430 48! 44" E;
thence N 48° 581' 31" E 42.06 feet to a point in that
curved line -having a radius of 1200 feet as described in
"Parcel 31411, in a Final Order of Condemnation had in
Superior Court Case No. 667381, a certified copy of which
is recorded in Book 54266, page 176, of Official Records in
the office -of said recorder, a radial line from said last
mentioned point bears S 440 04! 55" E; thence along
said last mentioned curved -line southwesterly 252000 feet;
thence tangent to said last mentioned curved line S 330
53' 10" W 94.94 feet to the southerly line of said Lot 1;
thence`"along the southerly line of said Lot 1 N 890 301 17" W
20.36 feet to the point of beginning.
Said territory shall be designated as "West Covina Northeasterly Annex-
ation District No, 1640
-SECTION 2. The City Clerk shall certify to the adoption of
this ordinance, and prior to the expiration of fifteen days from the
passage thereof, shall cause the same to be published once in the West
Covina Tribune, a newspaper of general circulation published and circu-
lated in the City of West Covina, and thirty days from and after the
final passage thereof shall file a certified copy thereof with the
Secretary of State of the State of California, and after such certified
® copy has been so filed, and a certificate of the Secretary of State
certifying to its filing has.been received by the City of West Covina,
the City Clerk shall file a copy of the map of said territory with the
following: The County Surveyor of Los Angeles County; the County
Recorder of Los Angeles County; the Board of Supervisors of the County
of Los Angeles; the County Assessorof said County; the County Engineer
of said County; the Board of Equalization of the State of California,
and the Census Bureau of the United States Government.
