Ordinance - 551n ORDINANCE NO. 551 AN ORDINANCE OF THE.CITY COUNCIL OF THE CITY OF WEST COVINA AMENDING ORDINANCE N0..325 BY THE ADDITION.THERETO OF PROVISIONS RELATING TO_PRECISE PLANS OF DESIGN....,- The City Council of the City of West Covina does ordain as follows: SECTION 1. The City Council does hereby find, determine and declare that the following amendments of the zoning ordinance •� have been duly initiated, that notice of hearing thereon has been duly given and published, that public hearings thereon were duly held -by the Planning Commission and by the City Council and that the public convenience and necessity and the general welfare require that the following amendments be made. SECTION 2. Ordinance No. 325, passed and approved the 28th day of June, 1954, is hereby amended by the addition thereto of a new Article 13.5 entitled Precise Plans of Design consisting of Sections 1350 to 1358, both inclusive, which are hereby added to said ordinance, reading as follows: Article 13.5 PRECISE PLANS OF DESIGN Section 1356: WHEN REQUIRED. No person -shall commence any use for which an unclassified use permit is required or any use not permitted in either the R-A, R-1 or R-2 Zone, and no building permit shall be issued for any structure to be used for or in con- junction with any such use, until a precise plan of design covering the parcel or parcels to be so used shall be approved and adopted as herein provided. Section 1351: CONTENTS OF. Such precise plan of design • shall specify and include: (1) The location, size, height, and type of all structures including signs, walls and fences. (2) The location, size and dimensions of all yards and set -backs and all spaces between structures. (3) The location, dimensions and method of improvement of all driveways, parking areas, walkways and means of access, ingress and egress. (4) The location, dimensions and method of improvement of all property.to be dedicated to the public or to public utilities. (5) General nature of the proposed use. Section 1352: ADOPTION OF. Any such precise plan of design may be rejected, adopted,,,modified and adopted; or adopted subject to conditions. -Any such precise plan of design after adoption, may be amended in the same manner as a precise plan of design is first adopted hereunder. Section 1353: GROUNDS FOR REJECTION.' If the proposed precise plan of design would substantially,depreciate property values in the vicinity or would unreasonably interfere with the use or enjoyment of property in the uicinity by the occupants thereof for lawful purposes or would endanger the -public peace,:, health, safety or general welfare, such plan shall be rejected or shall be so modi- fied or conditioned before adopton'-as to remove the said objections. Otherwise, such proposed precise plan shall be approved. Modifica- tions And conditions may be imposed only to the extent reasonably necessary in connection with the proposed use'to remove the said objections, and to that extent may impose -greater, but shall not permit lesser, restrictions than those imposed by this ordinance. Section 1354:' PROCEDURE. Application for approval of a precise plan of design shall be made in such form as the Planning Commission shall prescribe. The procedure (but not the grounds) set forth in Articled7 of this ordinance shall -apply to the processing and approval or rejection of purposed precise plans of design. Section 1355 ADOPTION SUBJECT TO CONDITION: A precise plan of design may be approved,and adopted.;subject.to the granting of a change of zone, an unclassified use permit, a variance, or the approval of a final subdivision map, and the Planning Commission or City'Council may require such a precise plan of design to be submitted prior to the granting or recommending of a zone change, variance or unclassified use permit. Section 1356:_ COMPLIANCE REQUIRED. No person shall violate or fail to comply with any adopted precise plan of design or any con- ditions or provisions thereof nor shall a building permit be issued for any structure which would violate or fail to comply with any adopted • precise plan of design for the parcel or parcels on which such struc- ture is to be located. Section 1357: CONTINUANCE OF EXISTING'PLANS. Any precise plan heretofore adopted and now in,effect,,whether..adopted pursuant to the procedure herein set forth or'not, and whether adopted by ordi- nance or resolution, is hereby approved and continued in force with the same effect as if adopted hereunder, and this shall be so whether or not the ordinance or resolution heretofore adopting the same shall hereby or hereafter be repealed or rescinded. Section 1358:' DISTINCTION FROM OTHER PRECISE PLANS. The precise plans of design referred,to herein are not to be confused with or opnsidered to be "precise plans" as referred to in the Government Code of the State of California. -2- U • SECTION 3.
