AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA PROVIDING FOR ISSUANCE OF PROMISES
TO APPEAR IN COURT OR BEFORE AN OFFICER AUTHORIZED
TO RECEIVE BAIL OF PERSONS ARRESTED FOR VIOLATIONS
OF CITY ORDINANCES; THAT FAILURE TO APPEAR AT TIME
AND PLACE SHALL BE A MISDEMEANOR; FOR ISSUANCE OF
WARRANT OF ARREST; APPLICATION OF ORDINANCE TO
ORDINANCES HERETOFORE PASSED AND ADOPTED AND ORDI-
NANCES ADOPTED IN THE FUTURE; AND PENALTY FOR
VIOLATIONS.
The City Council of the City of West Covina does hereby
• ordain as follows:
SECTION 1. Whenever any person is arrested for the violation
of any ordinance of the City of West Covina, which declares therein that
any violation is a misdemeanor, and such person is not immediately taken
before a Magistrate as more fully set forth in the Penal Code of Cali-
fornia, the arresting officer shall prepare in triplicate a written
notice to appear in court that shall contain the name and address of
such person, the offense charged, and the time and place where and when
such person shall appear in court and shall fully follow the provisions
of Section 853.1 of the Penal Code of California.
SECTION 2. The provisions of this ordinance and the pro-
cedure outlined in Sections853.1, 853.2, 853.3 and 853.4 of the Penal
Code of California shall apply to all ordinances of the City of West
Covina heretofore and hereafter adopted -and approved by the City Council,
violations of which are punishable as misdemeanors.
SECTION 3. Any person wilfully violating his written promise
to appear in court or before an officer authorized to receive a deposit
of bail is guilty of a misdemeanor regardless of the disposition of the
charge upon which he was originally arrested.
SECTION 4. Whenever any person who has signed a written
promise to appear at a time and place specified in his written promise
•to appear and who has not posted bail, as provided in Section 853.1 or
1269(b) of the Penal Code of California, the Magistrate shall issue and
have delivered for execution a warrant for such person's arrest within
twenty days after failure of such person to appear as promised, or if
such person promises to appear before an officer authorized to accept
bail other than a Magistrate and fails to do so on or before the date
which he promised to appear, then, within twenty days after the delivery
of such written promise to appear by the officer to a Magistrate having
jurisdiction over the offense.
When such person violates his written promise to appear
before an officer authorized to accept bail other than a Magistrate,
the officer shall immediately deliver to the Magistrate having juris-
diction over the offense charged the written promise to appear and the
complaint, if any, filed by the arresting officer.

SECTION 5. Pursuant to the provisions of Section 1269(b) of
the Penal Code of California, the Chief of Police shall designate such
officers of the Police Department as an officer authorized to accept bail.
SECTION 6. Upon conviction of any person for failing to
comply with or for violating any provision of this ordinance, he shall
be punished by imprisonment in the City Jail or in the County Jail for
a period not to exceed six months, or by a fine of not to exceed Five
Hundred Dollars, or by both such fine and imprisonment.
SECTION 7. The City Clerk shall certify to the passage of
this ordinance and shall cause the same to be published in the manner
• required by law.
