Ordinance - 546ORDINANCE NO. 546 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA AMENDING ORDINANCE NO. .499 RELATING TO THE CONSTRUCTION OF CONCRETE CURBS, GUTTERS AND SIDEWALKS. The City Council of the City of West Covina does ordain as follows: SECTION passed on the.22nd as follows: 1. Section 2 of Ordinance No. 499, approved and day of October, 1956, is hereby amended to read . "SECTION 2. Construction of Portland Cement Concrete Curbs, Gutters and Sidewalks in Conjunction with Building Construction. Any person or persons constructing or arranging for the con- struction of a building or dwelling shall also provide for the construction of Portland Cement concrete curbs, gutters and sidewalks in accordance with the standard specifications of the City of West Covina unless adequate standard Portland Cement concrete curbs, gutters and sidewalks already exist along all street frontages adjoining the lot or lots on which the building or dwelling is to be constructed, except as provided in the fol- lowing Sections hereof. Such curbs, gutters and sidewalks, where required, shall be completed before a certificate of completion or certificate of occupancy is issued." SECTION 2. Section 4 of said Ordinance No. 499 is hereby amended to read as follows: "SECTION 4. Modification of Portland Cement Concrete Curb, Gutter and Sidewalk Requirements. The provisions of Section 2 may be modified or waived by the City Engineer under the follow- ing circumstances and to the following extent, and under such reasonable conditions as he may impose: "(a) Portland Cement Concrete curbs and gutters only shall be required where the topography is such that the installation • of Portland Cement concrete sidewalks would be impractical in the opinion of the City Engineer. "(b) Portland Cement concrete curbs, gutters or sidewalks need not be installed where the final street grade cannot readily be established by the City Engineer. "(c) Where the street for practical reasons has not been or cannot be readily graded to the established grade which would enable proper location of curb and sidewalks. "(d) Where installation of Portland Cement concrete side- walks would be hazardous to pedestrians because of the grade." -1- SECTION 3. Section 5 of said Ordinance No. 499 is hereby amended to read as follows: "SECTION 5. Exceptions to Curb, Gutter and Sidewalk Requirements. Where parcels in residential zones are divided into one acre or larger lots, the Portland Cement concrete curb and gutters, or Portland Cement concrete curbs, gutters and side- walks need not extend a greater distance than the sideyards or side and rear yards in the case of corner lots as defined in the Zoning Ordinance and measured from the principal structure or structures on the parcel or lot. "Portland Cement concrete sidewalks need not be installed • in single family residential zones except on streets shown for sidewalks on the Master Plan of Sidewalks approved by the City Council, nor in any block (meaning one side of a street between intersecting streets) where fifty percent or more of the frontage is in lots or parcels which have been improved with a permanent dwelling but not with sidewalks." SECTION 4. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published as required by law.
