AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA DIRECTING THAT NO BUILDING PERMIT BE ISSUED FOR
ANY BUILDING OR STRUCTURE IN CONFLICT WITH AND PRO-
HIBITING ANY OTHER USE IN CONFLICT WITH A PROPOSED
AMENDMENT TO THE ZONING ORDINANCE.
The City Council of the City of West Covina does ordain as
f ollows :
SECTION 1. The City Council hereby finds, determines and
declares:
A. That by Resolution No. 1080 , adopted and approved the
19th day of February, 1957, the City Council initiated proceedings for
the amendment of the zoning ordinance so as to reclassify as R-A
(Residential Agricultural Zone) all property in the City of West Covina,
described as follows:
All land acquired by the State of California for Free-
way Purposes within the City and which is not in present
use for actual freeway, street or highway purposes,
except that portion thereof described in Ordinance No.
512, adopted the loth day of December, 1956.
B. That the Planning Commission, in good faith, is conducting
or intends to conduct studies within a reasonable time and to conduct
a hearing or hearings for the purpose of making a recommendation to the
City Council relative to the adoption of said proposed amendment of the
zoning ordinance.
C. That the said proposed amendment cannot be enacted and made
effective for a period of some fifty days or more because of the neces-
sity of complying with the procedural requirements of the state law.
D. That prior to the time said amendment can become effective,
a number of persons, unless restrained, will obtain building permits
and commence immediate construction of buildings and structures upon
said land which will not conform to the Comprehensive Zoning Plan or to
•the provisions of the said proposed amendment; that said buildings
and structures will violate the Comprehensive Zoning Plan provisions as
to use, height, bulk and area, and if said buildings and structures
are erected, they will irreparably damage neighboring properties; and
the erection of a number of buildings or structures contrary to the
provisions of said proposed amending ordinance will constitute a per-
manent and irreparable damage to the City of West Covina and to the
inhabitants of the districts in which such buildings and structures are
erected, and will hamper the future growth of the City and will impair
the welfare of its citizens and inhabitants.
SECTION 2. No building permit shall be issued by any officer,
official or employee of the City of West Covina for any building or
structure not in conformity with the provisions of said proposed

amendment until the said proposed amendment shall have been adopted and
shall become effective or until proceedings for the adoption thereof
shall have been dismissed. If any building permit shall hereafter be
issued contrary to the,provisions of this Section, such building per-
mit shall be void.
SECTION 3. Any other use which would be or is in conflict
with the provisions of said proposed amendment or of the zoning ordi-
nance, as changed by said proposed amendment, is hereby prohibited
until the said proposed amendment shall have been adopted and shall
become effective or until proceedings for the adoption thereof shall
have been dismissed. This Section shall apply to all persons natural
and corporate and to the state, counties, cities, and any and all
political agencies or subdivisions or municipal or political corpora-
tions.
SECTION 4. This ordinance is hereby declared to be necessary
for the immediate preservation of the public peace, health and safety.
A declaration of the facts constituting its urgency is contained in
Section 1 of this ordinance.
SECTION 5. The City Clerk shall certify to the adoption of
this ordinance and cause the same to be published in the manner required
by law, and this ordinance shall take effect immediately upon its
adoption.
SECTION b. Any person, firm or corporation violating any of
the provisions of this ordinance shall, for each violation thereof, be
deemed guilty of a misdemeanor, and upon conviction by any court of
competent jurisdiction, shall be punishable by a fine of not more than
$500.00 or by imprisonment in the West Covina City Jail or the Jail of
the County of Los Angeles for a period of not exceeding six months, or
by both such fine and imprisonment. Each separate day or any portion
thereof during which any violation of this ordinance occurs or con-
tinues shall be deemed to constitute and shall constitute a separate
offense.
